Local Government Official Information and Meetings Act investigation
Rebekah Crook’s delay in making decision on request for official information
I refer to Assistant Ombudsman Chloe Longdin-Prisk’s letter of 15 November 2023 concerning the
complaint made by Ms Rebekah Crook about a delay in making a decision on a request for
information held by the Council about the Teitei Drive Development.
My final opinion
In that letter, Ms Longdin-Prisk informed you of my likely opinion that there has been a failure to
meet the statutory obligations imposed by the Local Government Official Information and
Meetings Act 1987 (LGOIMA).
I have not received any comments from you within the time specified, and so I have now
confirmed this as my final opinion on the matter.
The assurance given to me is that you have taken action to remedy your procedures in this area.
While it is unnecessary for me to make any further specific recommendations in this case, I do
want you to know that I regard timeliness, and compliance with the LGOIMA, as a fundamental
obligation. I will be drawing attention to situations where breaches of this nature occur, where
I consider it necessary.
I have advised Ms Crook and the Mayor of my final opinion.
Nāku noa, nā
Peter Boshier
