Thank you for your email of 9 July 2024, requesting information under the Official Information Act 1982
(the Act). Your request is an amendment of your official information request of 11 June 2024, which asked
the following:
1/ Please disclose the number of High Court Hearings that have been Initiated by Claimants in taking the

Your amended request of 9 July 2024 asks for this information, but for the past five years only.
On 6 August we extended the time limit for our decision on your request to 3 September 2024. We have
now completed our work on your request, and our response is provided below.
Our response
The information we are providing for your request is in the table below. This information has been
extracted from data held in our Legal Services systems. The information provided reflects how information

The below table comprises of decisions by the High Court in relation to both substantive hearings (S) and
applications for leave to appeal (L).

Leave: appeals to the High Court can be heard only with the leave of the court. Decisions that only
addressed whether leave should be granted are categorised as leave decisions.

Substantive: decisions that address the question of law raised by the appellant are categorised as
substantive decisions.
These all relate to appeals against decisions by the District Court under Part 5 of the Accident
Compensation Act 2001. It does not include other High Court matters where ACC was involved (for
example, Judicial Review proceedings).
