31 May 2024 requesting:
“On the 19th of January 2024 I submitted a complaint against a doctor to the
Medical Council for breaching advertising standards and the Medicines Act. I
understand that complaints are also forwarded to the HDC.
I wish to confirm that this complaint was forwarded to the HDC.
I also request the attachments that were sent with this complaint.
If an attachment has to be withheld because of the privacy provisions, e.g.
9(2)(a) of the OIA Act and would reveal the name of the doctor, I still request
the attachments to which 9(2)(a) does not apply.
If privacy provisions under 9(2)(a) apply because it woud reveal the name of
the doctor and the attachment cannot be provided I request the name of the
attached files to which 9(2)(a) applies (if the name itself does not breach
9(2)(a))."
We have considered your request under the Official Information Act 1982.
Refusal of request
We are unable to identify your complaint. Therefore, we refuse your request pursuant
to section 18(e) of the Official Information Act as the document alleged to contain the
information requested does not exist, or, despite reasonable efforts to locate it,
cannot be found. You may seek a review of this decision from the Office of the
Ombudsman.
You may wish to ask the Medical Council for the referral.
