INFORMATION REQUEST – Commissioner & Minister correspondence
We  write  in  response  to  your  email  dated  26  February  2024  in  which  you  requested  the
following information:
Can you please send me:
1.  letters  sent  and  received  between  TCC  commissioners  and  Ministers  of  the
Crown between 1 Jan 2024 and 26 Feb 2024
2.  text messages (including SMS, Whatsapp and Signal) sent and received between
TCC commissioners and Ministers of the Crown between 1 Jan 2024 and 26 Feb
2024.

We have considered your request in accordance with the Local Government Official
Information and Meetings Act 1987 (“LGOIMA”) and respond as follows:
1.  The documents listed below are attached.
  Attachment 1 - 31 January 2024 - Letter from Hon Chris Bishop – Development
of fast-track consenting legislation.
  Attachment 2 - 19 February 2024 - Letter from Hon Simeon Brown –
Implementing Local Water Done Well
There is one piece of correspondence that is withheld under the following sections of
LGOIMA:
 7(2)(c) protect information which is subject to an obligation of confidence or which
any person has been or could be compelled to provide under the authority of any
enactment, where the making available of the information
(i)

would be likely to prejudice the supply of similar information, or
information from the same source, and it is in the public interest that such
information should continue to be supplied; or

(ii)
would be likely otherwise to damage the public interest.
 7(2)(h) enable any local authority holding the information to carry out, without
prejudice or disadvantage, commercial activities.

 7(2)(i) enable any local authority holding the information to carry on, without
prejudice or disadvantage, negotiations (including commercial and industrial
negotiations)

2.  This part of the request is extended to 10 April 2024. The extension is required as
consultations necessary to make a decision on your request are such that a proper
response cannot reasonably be made within the original time limit.
You have the right to seek an investigation and review by the Ombudsman of this decision.
