1.0  PESTICIDE AND HERBICIDE APPLICATION 
Pesticide shal  mean any substance or mixture of substances which wil  eradicate or control any pest.  It 
includes plant growth regulators, defoliants, desiccants, and other weed control, insect control and disease 
control chemicals.  Herbicide shall mean any pesticide used for desiccating, control ing or kil ing any plants 
or severely interrupting their normal growth processes. 
Where pesticides/herbicides are to be used the Contractor must get approval from the Open Spaces 
Operations Team for al  chemicals to be used.  The contractor wil  use the least toxic technique possible 
when control ing pests and diseases and look for alternatives to chemicals where available and take and 
Integrated Pest Management approach.  The contractor wil  include the purchase cost of al  chemicals 
used in this contract as part of their Bil  of Quantities or Scheduled rates items. 
Please note: Spraying using herbicide/chemicals is not permit ed around playground edges.  Mechanical 
or non-toxic methods must be used at al  times. 
The Contractor shal  comply with al  requirements of the:

Hazardous Substances and New Organisms Act 1996 
ii. 
Operative Environment Bay of Plenty Air Quality Plan. 
iii. 
A guide to applying agrichemicals – Responsibilities of applicators, Bay Plenty Regional Council. 
iv. 
Hazardous Substances and New Organisms (Personnel Qualifications) Regulations 2001 
 
All Pesticides/herbicides used by the Contractor must have a hazard classification no greater than “Harmful 
Substance” as defined in the Hazardous Substances and New Organisms (HSNO) Act 1996. 
 
•  Acute Toxicity 6.1E 
•  Chronic or Systemic toxicity 6.9B 
•  Toxic to Aquatic Life 9.1C 
 
In additions, the Contractor shal  ensure that the application complies with NZS 8409:2004 Management of 
Agrichemicals. 
In accordance or in addition to NZS 8409:2004, the fol owing are required to be undertaken: 
a. 
The spraying operation shal  be managed by an experienced chemical applicator. 
b. 
Al  staf  using or applying any agrichemical by ground based application methods shal  hold a current 
Approved Handler Test Certificate, in accordance with the requirements of Hazardous Substances 
and New Organisms Act 1996. 
c. 
Al  staff using or applying any agrichemical by ground based application methods shall hold, as a 
minimum, a current Approved Handler Certificate as detailed within the Hazardous Substances and 
New Organisms (Personnel Qualifications) Regulations 2001. 
d. 
The Contractor shal  not spray outside properties contained within the no spraying list held by the 
Principal. 
e. 
Equipment to be used for the spraying operation within gardens, fence lines and other similar works 
shal  be confined to low pressure knapsack sprayers and motorised low pressure plant with a 
handgun and a shroud around the spray nozzle approved by the Open Spaces Operations Team. 
f. 
Large open areas to be sprayed can be completed using a motorised boom spraying arrangement 
with appropriate shrouds fit ed. 
g. 
Al  records of spraying undertaken shal  be submit ed with the monthly report in conjunction with the 
Quality Statement. 
Signs are to be erected by the Contractor to advice of pesticide use, and of the times since the spray have 
taken place.  Signs for chronological placements include “Spraying in Progress” and “Pesticide Spraying 
Completed in the Last 48 Hours”.

The Contractor is responsible for the supply, cartage, col ection, erection, changing and removal of signs. 
Signs are to be in accordance with Council’s signage specification for spray signage.  The contractor wil  
make al  Public notifications required by current legislation or regulations as wel  as any required by the 
Open Spaces team and include this as part of their lump sum payment. 
Signs are to be placed at al  entrances to reserves.  Where there are wide road frontages with unspecific 
entrances, then signs are to be placed in conspicuous locations at frequent intervals. 
The Contractor shal  record al  uses of pesticides and/or herbicides in their monthly report, including details 
of the location, pest/weed control ed, and pesticide/herbicide used. 
The Contractor shal  supply al  copies of current approved handler certificates to the Principal.
