Tēnā koe John, Official Information Act 1982 (OIA): Summary of request I refer to your official information request dated 25 January 2024 for the following. I noted, Decisions are published after a 20-working day appeal period and remain on the public register for 3 years. Would you still keep all the decisions somewhere within your file system? If so, may I kindly seek the case number, name and the decision date from 1st Jan 2018 to 1st Jan 2021. (e.g. 23 Nov 2023 C39863 Anuj Bisht / Vikas Kapoor) Also, what is the reason for not keeping all the decision on your website?
We have considered your request under the OIA. Information being released The requirement for publication on the Register is set out in section 66(1)(f)(v) of the Real
Estate Agent’s Act 2008, which requires that the Register must include against each licensee’s record “any action taken on a disciplinary matter in respect of the person in the last 3 years”. The REA approach is consistent with this requirement. Information being refused We note that all CAC outcomes are listed in the Decisions Database which is available on
our website. As such we are declining your request for historical decisions under section 18(d) of the OIA as the information is publicly available. Next steps You have the right to seek an investigation and review by the Ombudsman of this decision.
