Thank you for your request made via email dated 4 December 2023 in which you requested
the following:
“May I kindly request a copy of your procurement policy and procedure. How did you
select law firm Luke, Cunningham and Clere to do the review. Can you please provide
your procurement process within this external review round”
We have considered your request under the OIA.
Information being released
We attach REA’s Procurement Policy which captures the policy and procedure requirements.
REA does not have a separate procedure document. Our Policy has been developed in line
with and refers to the Government Procurement Rules. This Policy is currently being
reviewed and may be updated once that review is complete.
With regards you question as to how REA selected law firm Luke Cunningham and Clere to
undertake the external review in 2023, I can confirm that the REA uses the All-of-
Government External Legal Services Panel, which provides us with access to 30 providers
with a variety of areas of speciality.
REA selects legal providers from the panel based on the expertise and the nature of the work
required.
In 2023 Luke, Cunningham, and Clere was selected from the panel in accordance with clause
14 of our Procurement Policy based on their expertise in both the REA regulatory context
and experience with a number of other conduct regulation regimes.
