Request made under the Official Information Act 1982 
 
Thank you for your email of 26 September 2023 requesting the following information under the Official 
Information Act 1982 (the Act): 
 
Please provide the cost of installing and renting or purchasing the scaffolding side protection 
running between the railway line and the sea along the entire length of the Petone-Ngauranga 
cycleway 

 
The scaffolding side protection fence (Vortok barrier) running along the KiwiRail rail line is being used 
as a safety system between the Te Ara Tupua project construction site and the KiwiRail tracks.  
 
Vortok barrier is a universal and adjustable rigid barrier system used on rail projects for the safety of 
people and protection of track assets. It is required for the protection of our onsite workforce alongside 
an operational rail line with moving trains.  
  
It was purchased by our construction contractors within Te Ara Tupua Al iance with the intention of on 
selling upon the completion of the project. 
 
As such, we are withholding the costs of the scaffolding running between the railway line and the sea 
along the entire length of the Petone-Ngauranga cycleway under section 9(2)(j) of the Act as the 
information is commercial y sensitive. This part of the section enables a Minister of the Crown or any 
public service agency or organisation holding the information to carry on, without prejudice or 
disadvantage, negotiations (including commercial and industrial negotiations). 
 
With respect to the information that has been withheld, I do not consider there are any other factors 
which would render it desirable, in the public interest, to make the information available. 
 
Under section 28 of the Act, you have the right to ask the Ombudsman to review my decision to
