I refer to your request under the Official Information Act 1982 (the Act) received on 18 September 
2023 requesting the following information from the Ministry of Business, Innovation and 
Employment (Ministry): 
 
“1. Please can you advise if the department of immigration NZ shares all information with 
the DIA?  
 
1A. If an applicant had declared any criminal history to the department of immigration and 
provided appropriate information to be granted a waiver for both residency and permanent 
residency visa's is the specific information shared with the DIA?” 
 
Our Response 
 
Please can you advise if the department of immigration NZ shares all information with the DIA? 
I can advise that Immigration New Zealand (INZ) shares information with the Department of Internal 
Affairs (DIA).  
When an individual applies for a visa or citizenship, the application states that the information 
provided in that application may be shared with relevant government agencies.  By signing the 
application form the applicant is giving authority for that information to be shared. DIA can make a 
request under the Official Information Act for information not contained in an application.  This 
request is processed by INZ in line with the Act’s legislative requirements. 
If an applicant had declared any criminal history to the department of immigration and provided 
appropriate information to be granted a waiver for both residency and permanent residency visa's 
is the specific information shared with the DIA? 
As noted above DIA can request information INZ holds, about an individual, under the Official 
Information Act and INZ processes those requests in line with the requirements under the Act.   
I refer you to the publicly available Customer Nominated Services Information Sharing Agreement 
(ASIA) that is posted on the DIA website which sets out at Schedule 5 what information is shared 
between the Ministry or in this case INZ and DIA without the need of an OIA request. Anything 
outside of this scope, would require DIA to provide a request under the Act to INZ.
