Thank  you  for  your  email  of  31  July  2023  requesting  the  following  information  under  the  Official 
Information Act 1982 (the Act): 
 
We  are reaching  out to you  to  request  copies  of  any  research  –  including  feasibility 
studies and business cases – that your organisation has commissioned, produced, or 
holds copies of on the future and current uses of the Avondale Racecourse in Auckland. 
 
Two documents have been found to be within scope of your request. These documents offer legal 
advice  and  as  such  are  withheld  in  full  under  section  9(2)(h)  of  the  Act,  including  their  titles,  to 
maintain legal professional privilege. 
 
In terms of section 9(1) of the Act, I am satisfied that, in the circumstances, the decision to withhold 
information  under  section  9  of  the  Act  is  not  outweighed  by  other  considerations  that  render  it 
desirable to make the information available in the public interest. 
 
You  have  the  right  to  seek  an  investigation  and  review  of  my  response  by  the  Ombudsman,  in 
accordance with section 28(3) of the Act. The relevant details can be found on the Ombudsman’s
