[FYI request #23492 email]
Dear Adam
Thank you for your Official Information Act 1982 (OIA) request received 15 July 2023, in
which you requested information about the proceeds from infringement notices. I have
answered each part of your request below.
I request information relating to section 141 of the Land Transport Act 1998,
which states:

141
Provisions relating to infringement fees
(1)
The infringement fee payable in respect of an infringement offence is the
appropriate infringement fee prescribed in respect of the relevant offence
by or under this Act.

(2)
If an infringement fee is paid to an enforcement authority other than the
Police, the enforcement authority must give the Commissioner the
particulars of the infringement and of the payment that the Commissioner
requires.

(3)
Subject to subsections (4) and (5), all infringement fees received under
this Act by an enforcement authority or recovered under the Summary
Proceedings Act 1957 must be paid into a Crown Bank Account, except
that the enforcement authority may retain any portion of the fees so
received that the Minister of Finance from time to time approves as being
the expenses incidental to their col ection.

1. How much in fines we collected and paid into this crown account for the last 5
years (each year).
I refer you to the schedule of non-departmental revenue and expenses found within the
Police Annual Report. The Annual Report for each year is published on the Police
website: https://www.police.govt.nz/about-us/publications/corporate/annual-report
This part of your request is therefore refused pursuant to section 18(d) of the OIA as the
information requested is or wil  soon be publicly available.
2. and for each year how much has NZ police been able to keep for "expenses
incidental to their col ection".

Police does not keep any funds for “expenses incidental to their collection". Al  funds
received from infringement fees are transferred to the Crown.
3. Additionally what is the current balance of the crown account and what are the
funds used for.
Infringement fee revenue is not col ected into a specific account, but is transferred to the
Government’s consolidated fund, along with al  other Crown revenue. It is then allocated
based on the priorities of the Government of the day. This al ocation is reflected in the
Government’s annual budget which sets out how much revenue the Government collects
and how it intends to spend it. Further information on the last budget may be found at
budget.govt.nz
I trust this information is satisfactory in answering you request. If you are not satisfied,
you have the right to seek an investigation and review by the Ombudsman of this
decision. Information about how to make a complaint is available at
www.ombudsman.parliament.nz or freephone 0800 802 602.
Yours sincerely
