Dear Amelia,
Thank you for your email of 20 May 2023 requesting information relating to exemptions made
under the Agricultural Compounds and Veterinary Medicines Act 1997. Your request has
been considered under the Official Information Act 1982 (OIA).
You requested the following:
Related to the Agricultural Compounds and Veterinary Medicines Amendment Act
2007. Please provide all compounds listed by the director General as exempt under
section 8B and section 8C. Please also provide any relevant conditions or
regulations imposed with their use.
And you later refined your request:
Can you please provide the last 12 months for 8C?
On 19 June 2023, MPI extended the time limit to respond to your request to 1 August 2023.
There have been no exemptions made under section 8B of the Agricultural Compounds and
Veterinary Medicines Act 1997 (the Act). Therefore, this part of your request is declined
under section 18(e) -
that the document alleged to contain the information requested does
not exist.
The relevant compound(s) and conditions of approval for the applications for an exemption
under section 8C of the Act made between 1 June 2022 and 31 May 2023 and approved
prior to 20 July 2023 are included as Appendix One.
Please note that approvals are made for a specific organisation or veterinarian to use the
relevant compound according to the conditions of approval; approvals do not allow
organisations or veterinarians that weren’t named in the approval to use the compound
unless this is explicitly stated in the conditions of approval.
Some information has been withheld pursuant to the following sections of the OIA:
• section 9(2)(a)—
to protect the privacy of natural persons.
• section 9(2)(b)(ii)—
to protect information where the making available of the
information would be likely unreasonably to prejudice the commercial position of the
person who is the subject of the information.

The details of exemptions approved under section 8C of the Act for research purposes have
been withheld under section 9(2)(b)(ii) of the OIA -
to protect information where the making
available of the information would be likely unreasonably to prejudice the commercial
position of the person who is the subject of the information.
MPI is satisfied that in the circumstances of this case, the withholding of the information is
not outweighed by other considerations which render it desirable in the public interest to
make the information available.
