Thank you for your emails of 4 and 10 August 2022 highlighting your sea-level rise related
concerns about the resource consent application for the Bayswater development in Auckland.
I agree it is vital that climate change impacts such as sea level rise are taken into account in
land use planning decisions. As you note, failure to do so will result in future costs to address
these impacts.
Decisions on resource consent applications such as this are the responsibility of local
government. As such, I do not consider it would be appropriate for me to make any public
statements regarding the appropriateness of this proposed development.
More broadly however, the Government is committed to replacing the Resource Management
Act and reforming the resource management system by establishing a new Spatial Planning
Act, Natural and Built Environments Act and Climate Adaptation Act.
Together, these Acts will provide changes which will help to ensure that decision makers are
appropriately considering the impacts of climate change.

On behalf of Hon James Shaw, Minister of Climate Change, thank you for your email of Sunday, 26
February 2023 regarding the
Climate Adaptation Bill.
The Climate Adaptation Bill (CAB) is expected to be introduced into parliament this year and will lay the
foundations of a managed retreat system, to strengthen the toolbox we have to adapt to severe
weather and other impacts linked to climate change.
However, this is only one part of how we will adapt to climate change. The National Adaptation Plan,
released last year, sets out our longer-term planning to help us build more resilient homes,
infrastructure and communities, and we’re currently looking at what parts of that might be accelerated.
The other two components of resource management reform, the Natural and Built Environment Bill and
Spatial Planning Bill, introduced to Parliament last year, also support how we adapt to climate change
and risks from natural hazards. The National Planning Framework will provide direction on reducing
natural hazard risks and on climate change adaptation while Regional Spatial Strategies will identify
areas that are at risk of sea level rise, and other natural hazards, and require an appropriate response.
