[FYI request #22295 email]
Dear Kurt
Request for information
Thank you for your Official Information Act 1982 (OIA) request of 20 April 2023. You
asked for information regarding an incident involving a motorcycle hitting Ms Marama
Davidson.
You requested:
1.
Was this a controlled (traffic light) crossing?
2.
At what time and what was the precise location of the crossing involved?
3.
Have you requested and/or received any CCTV footage of this event from
Auckland Transport or any other organisation?
4.
If so I request any cctv footage as part of this OIA.
This matter is the subject of an active investigation therefore, your request is refused in
full under s6(c) of the OIA, as the making available of that information would be likely to
prejudice the maintenance of the law, including the prevention, investigation, and
detection of offences, and the right to a fair trial.
Please note that as part of its commitment to openness and transparency, Police
proactively releases some information and documents that may be of interest to the
public. An anonymised version of this response may be publicly released on the New
Zealand Police website.
You have the right to seek an investigation and review by the Ombudsman of this
decision. Information about how to make a complaint is available at
www.ombudsman.parliament.nz or freephone 0800 802 602.
Yours sincerely
Inspector George Fanamanu
