Thank you for your email of 15 March 2023 requesting information relating to Julian 
Batchelor and the Cape Brett walkway. Your request has been considered under the Official 
Information Act 1982 (‘OIA’).  
You requested the following:  
[…] all information including correspondence, contracts, etc, regarding Julian 
Batchelor; All information regarding the involvement of Julian Batchelor with the Cape 
Brett Walkway, including all information, correspondence, etc, from local hapu, 
whanau and individuals regarding Julian Batchelor, and the Cape Brett Walkway. 
All information regarding payments from DoC to Julian Batchelor. 

On 29 March 2023, the Department of Conservation (‘the Department’) contacted you, 
suggesting refining the timeframe in which you are seeking information from 1 January 2015 
to the date of your request.  
As we have not heard back from you regarding our suggested refinement, we proceeded 
with the timeframe for the information you requested to be from 1 January 2015 to 15 March 
2023. 
If you request information outside this timeframe, please lodge another request with our 
Government Services team, at [email address].  
On 14 April 2021, we extended the timeframe to respond to your request to 19 May 2023, as 
your request is for a large quantity of information, and consultation that is necessary to make 
a decision on your request.  
On 19 May 2023, we advised you that we had made a decision on your official information 
request, and that we would provide you with a response by 23 May 2023.   
Your questions and our responses are listed below:

Please find attached, as Appendix One, all information relating to these matters from 1 
January 2015 to the date of your request. Table 1 – Schedule of Documents, also attached, 
provides further detail on the information released to you in Appendix One.  
 
We are also providing you documentation on the one arrangement that the Department 
currently has with a third-party at the Cape Brett Track. Despite this documentation falling 
outside the 1 January 2015 timeframe, we are releasing this to you, also for context.  
 
Some information has been withheld in Appendix One, pursuant to the following sections of 
the OIA:  
  Section 9(2)(a) – to protect the privacy of natural persons, including that of deceased 
natural persons 
  Section 9(2)(ba)(i) – to protect information which is subject to an obligation of 
confidence or which any person has been or could be compelled to provide under the 
authority of any enactment, where the making available of the information would be 
likely to prejudice the supply of similar information, or information from the same 
source, and it is in the public interest that such information should continue to be 
supplied
 
  Section 9(2)(b)(ii) – to protect information where the making available of the 
information would be likely unreasonably to prejudice the commercial position of the 
person who supplied or who is the subject of the information
 
  Section 9(2)(h) – to maintain legal professional privilege 
  Section 9(2)(i) – to enable a Minister of the Crown or any public service agency or 
organisation holding the information to carry out, without prejudice or disadvantage, 
commercial activities
.

All information regarding payments from DoC to Julian Batchelor. 
 
The Department has not made any payments to Julian Batchelor. Therefore, part three of 
your request has been refused pursuant to section 18(e) of the OIA, as the information 
requested does not exist.  
 
Please refer to items 15, 40, 41, and 42 in Table One – Schedule of Documents relating to 
requests for payments and further advice the Department sought on this matter. 
 
In making my decision, I have considered the public interest considerations in section 9(1) of 
the OIA and determined there are no public interests which outweigh the grounds for 
withholding. 
 
You are entitled to seek an investigation and review of my decision by writing to an 
Ombudsman as provided by section 28(3) of the OIA.
