Further to my previous, below is the current draft of the text for our note to
MinDef.  Is there anything that would cause an allergic reaction from Police?
1.   The purpose of this note is advise of a NZ Police request for NZDF support to assist in the removal of
protest vehicles in the vicinity of the Parliament buildings, and to seek Ministerial direction for this
support.  This request fol ows Police not being able to secure commercial operators to move the vehicles.
2.   Police have requested NZDF support to remove vehicles from the vicinity of Parliament; including from
Lambton Quay, Molesworth Street, and Aitken Street.  There are approximately 180 vehicles and trailers
of different types.  Police will be responsible for cordon and security of both sites; i.e. in the vicinity of
Parliament and where the vehicles are taken to.  Current planning has a holding area for vehicles in the
vicinity of Sky Stadium.  Police have advised that the NZDF task will be limited to the conduct of vehicle
removal by towing vehicles from their current location to the holding area.  Police will remain the lead
agency throughout the operation, with limited to providing logistic support in the form of towing/recovery
resources.  It is planned that NZDF will work in a secure environment, provided by Police, and there is no
planned engagement by NZDF with the public or protestors.
3.   NZDF is scoping the feasibility of supporting this request.  Presently the use of specific NZDF recovery
vehicles and crews is being considered; as opposed to use of non-recovery vehicles or expedient towing
methods.  This will limit the number of assets able to be provided.  However noting that NZDF vehicles
are not designed to recover/tow civilian vehicles, the use of recovery vehicles and trained crews may
reduce damage to private property.  Presently NZDF will be able to provide XX recovery vehicles and YY
recovery crews; the additional crews able to extend vehicle operating hours.
4.   Depending on the number of recovery crews and the final number of vehicles on the site—as it is
anticipated some may leave of their own volition—the removal of vehicles from the Parliament site could
take 24-72 hours.  At present a large number of the trained NZDF-crews are on duty in MIQ in
Auckland.  If these personnel are released from that duty, and the NZDF infection-mitigation period (7
days) is waived, the personnel may be able to commence this task late Friday (11 Feb) or more likely
Saturday (12 Feb).
5.   NZDF would legally be able to conduct this task under Section 9(1)(a) of the Defence Act 1990 and, as we
would be working under the direction of the Police, under Section 113(1) and 113(2)(c) of the Land
Transport Act 1998.  There is a risk that the NZDF, or its personnel, would be subject to legal claims for
any damage that occurs to vehicles in the towing process.
I am still trying to confirm how many vehicles/crews we can provide, and when they
would be available.

I just have a few queries/points:
·    Is there a time that we are working to at this point?  For example support is needed not before X, but no later than Y.
·    We are currently working on the assumption that NZDF will be working in an environment that has been “cleared” by the Police;
i.e. any doing recovery operations is not going to be having to deal with protestors, vehicle occupants, etc.  This is important to
clarify as it gets into matters around the likelihood of NZDF personnel having to interact with the protestors, potentially defend
themselves, etc.
·    At present we are only looking to deploy recovery-specific vehicles, with trained crews; i.e. our own “towing” vehicles.  This will
limit the capacity that we are able to provide.  At this point we have not looked at ad hoc / expedient towing options; i.e. other
military vehicles using towing bars and such.  This will mean a fairly limited capacity in what we can provide, as we only have a
few towing vehicles (i.e. 2 – 5 recovery vehicles).  Please let us know if you need us to explore other options.
·    Our recovery vehicles are designed to tow military vehicles, so it is likely that damage will occur to non-military vehicles when
they are being towed.
·    Unfortunately, as it happens, most of our trained crews are currently in Auckland working in MIQ, so there is likely to be a time
delay in us deploying them.

I’m just trying to confirm the details of the possible use of NZDF resources to assist
in the removal of protest vehicles.
Below is the current draft of the text for our note to MinDef.  Is there anything that
would cause an allergic reaction from Police?  (I just want to check that I am not
misrepresenting the current Police plan)
1.   The purpose of this note is to advise of a NZ Police request for NZDF support to assist in the removal of protest
vehicles in the vicinity of the Parliament buildings, and to seek Ministerial direction for this support.
Task Request
2.   Police have requested NZDF support to remove vehicles from the vicinity of Parliament; including from Lambton
Quay, Molesworth Street, and Aitken Street.  There are approximately 180 vehicles and trailers of different
types.  The request follows Police not being able to secure commercial operators to move the vehicles.  Police
would remain the lead agency throughout the operation, with NZDF limited to providing logistic support in the
form of towing/recovery resources.
Legal Basis
3.   NZDF would legally be able to conduct this task under Section 9(1)(a) of the Defence Act 1990 and, as we
would be working under the direction of the Police, under Section 113(1) and 113(2)(c) of the Land Transport
Act 1998.
Proposed Plan
4.   The Police intention is to secure the site around Parliament and the establish a secure holding area in the
vicinity of Sky Stadium.  Police will be responsible for cordon and security of both sites.  Police advise that the
NZDF task will be limited to the conduct of vehicle removal by towing vehicles from their current location to the
holding area.  It is planned that NZDF will work in a secure environment, provided by Police, and there is no
planned engagement by NZDF with the public or protestors.
5.   NZDF is scoping the feasibility of supporting this request.  Presently the use of an NZDF recovery vehicle and
crew is being considered; as opposed to use of non-recovery vehicles or expedient towing methods.  This limits
the resources able to be provided.  However noting that NZDF vehicles are not designed to recover/tow civilian
vehicles, the use of a recovery vehicle and trained crew may reduce damage to private property.
6.   Depending on the final number of vehicles on the site—as it is anticipated some may leave of their own
volition—the removal of vehicles from the Parliament site could take a number of days.  At present the trained
NZDF-crew are on duty in MIQ in Auckland.  If these personnel are released from that duty, and the NZDF
infection-mitigation period (seven days) is waived, the personnel should be able to commence this on Saturday
(12 Feb).
Risks
7.   Damage to Private Property. There is a risk that the NZDF, or its personnel, would be subject to legal claims for
any damage that occurs to vehicles in the towing process; particularly as NZDF does not have immunity under
the Public Service Act for immunity from civil liability for good faith actions or omission in the performance or
exercise of duties or powers, as is held by many agencies.  Additionally NZDF cannot rely upon the immunities
conferred upon the NZ Police.
8.   Reputational Risk.  It is probable that the employment of the NZDF a response to civil protest action will
negatively impact the reputation of the organisation and government.  Therefore, while not legally required,
ministerial approval to undertake this task.
9.   Waiving post-MIQ stand-down.  Currently NZDF imposes a seven day stand-down period on all staff completing
duty at MIQ.  The recovery crew would have this requirement waived in order to be able to commence work
from Saturday (12 Feb).  Without a waiver the crew would not be available until Friday next week (18
Feb).  While infection prevention protocols have been fol owed while working at MIQ, this does increase the risk
of these individuals being a vector for Covid to be transmitted.

Although some are mentioned in the text above, we are wanting to confirm some
queries/points:

We have been getting a few queries from media around if NZDF have been asked to assist

  Training and drills will be around personal security of the Tow truck drivers should
the protestors break through the outer cordon and their personal safety is
threatened.
  There will no damage to the training area as this revolves around staff being on
foot and getting Driver back to their truck and drive away.
  In addition to the estimated number of two-trucks, what is the size of the
contingent during training (civilian vehicles, police vehicles, & personnel etc.)
  Up to six(6) tow trucks are expected to be involved.
  Duration of access to NZDF site (include specific access times, or do you need the
freedom to arrive/exit ?)
  At this stage timings are as per point 1 above.
  As Trentham Military Camp have identified a possible location (secure, but without
24/7 security) that is outside the main wire what are your security requirements
(ie will NZ POL or a Security contractor, for example, provide overnight watch on
the location?)
  Police and or security will be provided for the Tow  trucks in the enclosure.
  Does the contingent require access to Trentham Military Camp inside the main
wire? (current Covid settings makes this a little more tricky to arrange, however,
it’s good to know what your intent is for accommodation etc of the tow-truck
drivers are).
  Accommodation and messing will be off site
  An indication of what you sense the level of risk to be, in terms of attracting
unwanted attention, would be useful.
  Low to medium given the distance from Parliament.

Thank you for your time on the phone just now and to confirm our conversation:

I am currently working on planning for the protests underway at parliament.  Obviously our key
objective remains a negotiated resolution but we have also started some contingency planning
regarding actions we may need to taken, one being the removal of vehicles from the roadway.

You may have seen in the media there have been some issues sourcing local tow firms however
have a number of tow operators from across the North island who are prepared to travel to
Wellington to support the operation.  We have actions underway regarding protection for the tow
trucks and operators, certainly during their actions to remove vehicles but also need to securely
store them on their arrival and through until the conclusion of this stage of the operation.  Note
storage is for the tow trucks only – not the vehicles removed from the roadway.  We anticipate up
to 12 tow vehicles / trcuks.

As discussed, the request is for us to securely store the tow trucks at Trentham Camp –
commencing tomorrow through until Sunday 20th February 2022.

We would also appreciate the use of an area for us to do some training with police staff and the tow
operators to exercise and test our actions when deployed.

Earlier this evening I spoke with s. 6(a)

(acting Director GNZ) about an imagery collection requirement
in support of the NZ Police response to the Convoy Protest at Parliament in

HQNZDF has been forwarded this request for support from CDHQ. Is this aligned with the
PNHQ strategy in response to the protest action?

The plan around protest action involving the towing of vehicles has been approved by PNHQ

On face value, it looks like its something we can support; however, we’d a need a formal
request (email from PNHQ to HQNZDF, attention myself) outlining the following:

  Activity type (staging area – overnight parking of tow-trucks, broad description of drills and therefore how big and
what is the level of risk for damage to the training area etc)
  Staging Area , as the trucks will be leaving and returning to this area.
  Overnight parking from Tuesday the 15th February until Sunday the 21st February 2022
  Training and drills will be around personal security of the Tow truck drivers should the protestors break through
the outer cordon and their personal safety is threatened.
  There will no damage to the training area as this revolves around staff being on foot and getting Driver back to
their truck and drive away.
  In addition to the estimated number of two-trucks, what is the size of the contingent during training (civilian
vehicles, police vehicles, & personnel etc.)
  Up to six(6) tow trucks are expected to be involved.
  Duration of access to NZDF site (include specific access times, or do you need the freedom to arrive/exit ?)
  At this stage timings are as per point 1 above.
  As Trentham Military Camp have identified a possible location (secure, but without 24/7 security) that is outside
the main wire what are your security requirements (ie will NZ POL or a Security contractor, for example, provide
overnight watch on the location?)
  Police and or security will be provided for the Tow  trucks in the enclosure.
  Does the contingent require access to Trentham Military Camp inside the main wire? (current Covid settings makes
this a little more tricky to arrange, however, it’s good to know what your intent is for accommodation etc of the
tow-truck drivers are).
  Accommodation and messing will be off site
  An indication of what you sense the level of risk to be, in terms of attracting unwanted attention, would be useful.
  Low to medium given the distance from Parliament.

Thank you for your time on the phone just now and to confirm our conversation:

I am currently working on planning for the protests underway at parliament.  Obviously our key
objective remains a negotiated resolution but we have also started some contingency planning
regarding actions we may need to taken, one being the removal of vehicles from the roadway.

You may have seen in the media there have been some issues sourcing local tow firms however have
a number of tow operators from across the North island who are prepared to travel to Wellington to
support the operation. We have actions underway regarding protection for the tow trucks and
operators, certainly during their actions to remove vehicles but also need to securely store them on
their arrival and through until the conclusion of this stage of the operation. Note storage is for the
tow trucks only – not the vehicles removed from the roadway.  We anticipate up to 12 tow vehicles /
trcuks.

As discussed, the request is for us to securely store the tow trucks at Trentham Camp – commencing
tomorrow through until Sunday 20th February 2022.

We would also appreciate the use of an area for us to do some training with police staff and the tow
operators to exercise and test our actions when deployed.

RE: Current status of NZ Police requests to NZDF [SEEMAIL]

Update on current requests for support from NZDF:

1.    Request for support to tow vehicles – NZDF is not in a position to support this request due to a number of factors including
the unsuitability of our recovery platforms, a low trained state of many of our recovery personnel due to MIQ commitments
over the last 18 months and the requirement to waive imposed post-MIQ stand-down following MIQ tasking. A response has
been provided to the Police Commissioners Office.
2.    Request for potential use of VIP accommodation at Trentham – Trentham POC details have been passed to s. 9(2)(a)

who will visit Trentham to assess the accommodation suitability.
3.    Request to use secure carpark at Trentham for tow truck parking and staging area – Request approved.
4.    Request for an NZDF Liaison Officer in the PNHQ Major Operations Centre – Request approved until Fri 18 Feb and will be
re-assessed.
5.    Request for overhead imagery support – An appropriate image was collected and is in the process of being downloaded and
sent to Police. Comms have been established in case there is a need for further support products to be generated.

Police Intel battle rhythm for Op OVERSIGHT/CONVOY:

A MOC was established this morning at PNHQ under the name OP OVERSIGHT, as distinct from the
WLG District OP CONVOY.

In terms of planning cycle, the following meetings/outputs are scheduled at the MOC:
  0830hrs standup and Intelligence Update (summary of overnight activity – drawing largely on WLG Intsum)
  1200hrs standup and Intelligence Update
  1300hrs standup and Intelligence Update (summary of National Intsum to be released at 1600hrs)
  1600hrs National Intsum released

An updated ISP will be released in due course, and as ever your support and feedback is appreciated.
In the meantime, s. 9(2)(a)
is the JIG Manager should you have any immediate
questions.

of Police’s OP CONVOY. If it would help I could put you in contact with Police’s lead planner in the

As discussed yesterday the NZDF Planners are not required until Monday the 21st and should report
directly to s. 9(2)(a)
is one of the lead Inspectors involved in
the planning phase for Op CONVOY, as opposed to OP OVERSIGHT (which is based at PNHQ and
focused on the national perspective).

  When and where you want them, and the duration they will be required for. 1200HRS Monday 21 Feb, Wellington
Central Police Station, Cnr of Victoria and Harris Street, they will be required for a maximum of 5 days at this
stage (possibly shorter)
  Potential scope of the tasks required. The tasks will be looking at supply line challenges and any implications
regarding a longer term occupation
  A POC for these pers to engage with and meet on arrival.  s. 9(2)(a)

Having spoken with s. 9(2)(a)
as National Controller for OP OVERSIGHT (CONVOY 2022 Protest),
he has indicated a desire to convene a workshop this afternoon.

Timing for the workshop would be 1600-1730hrs at either PNHQ (TBC: s. 9(2)(a)
  to advise)
or Defence House.

s. 9(2)(a)
envisages a Sprint session, led by NSSD, in support of Police as lead agency.

s. 9(2)(a)  noted the success/value of the Sprint sessions led by DPMC in support of MoH as lead
agency through Covid.

The purpose of the meeting would be to identify additional considerations, resource implications,
and risks of the Options presented by the Commissioner and the Scenarios identified to date by
Police Intelligence. The thoughts, ideas, and experience of partner agencies is considered critical to
determining higher level system implications and identification of opportunities for agencies to
support Police as lead agency.

A rough agenda could include:
  Current situation update
  Options overview (as briefed to ODESC)
  Scenarios identified
  Analysis of options against scenarios to identify strategic implications/considerations

Your assistance in convening a meeting of key agencies is appreciated.

As a separate issue, Police will review assistance requirements for operational planning capability
and will engage directly with relevant agencies.
