Thank you for your request, received on 28 January 2023, for the fol owing information under the
Official Information Act 1982 (the Act):

I would like to request a list of vacancy (ministerial appointment only, e.g. board member, Lay
member, Trustee etc) that the nomination period has been closed but still under
consideration by the TEC or relevant Minister. If there is any, please indicate what stage they
are currently at and when you are expected to have a final outcome.
In your list, can you please included the date that vacancy been advertised, what method you
have used to publicly advertise the position, how many applicantion you have received and
when the vacancy been closed as well.
Also, I would like to know if you have any future opening in 2023. e.g. the position that will
call for nomination in the year of 2023.
In answering your questions, I refer to my previous letter to you in September 2022 where I outlined
the Ministerial appointment process and the role of the Tertiary Education Commission in advising
the Minister of Education.
The Minister makes one third of the appointments to governing councils of tertiary education
institutions (TEIs), with the exception of Te Pūkenga where nine of the 12 appointments are made by
the Minister. The Minister also makes appointments to two of the six Workforce Development
Councils (WDCs). The role of the Minister is set out in the Education and Training Act 2020 and in the
Orders in Council that established the WDCs. Legislation requires the Minister to consult a TEI council
before making any appointment, and for the WDCs, the Minister must appoint candidates nominated
by the council.
In the case of TEIs, the Minister also takes into account nominations made by their col eagues and by
the Government’s nominating agencies. The agencies the TEC contacts on the Minister’s behalf
include:
• Ministry for Women
• Te Puni Kōkiri
• Ministry for Pacific Peoples
• Ministry for Ethnic Communities
• Whaikaha – Ministry of Disabled People
The TEC’s role is to manage the process of appointment on behalf of the Minister of Education. The
TEC keeps the Minister up to date with appointments for members whose terms are due to expire in
the upcoming year, and, wherever possible, supports the Minister to make new appointments before
those positions fall vacant.
The nominations received by the Minister for those appointments are referred to the TEC for review.
In advising the Minister, for each appointment the TEC:
• Considers if reappointment is an option - the existing member’s contribution and the
length of term already served is taken into consideration;
• Undertakes a skills analysis of the council to identify skills gaps, gender balance, etc, using
the Framework for Selection published on the TEC website; and
• Shortlists nominees for the Minister’s consideration, using the Framework for Selection.
Once the Minister has identified their preferred appointees, the role of the TEC is to provide the
Minister with the support and documents they need to complete an appointment and take it through
the Cabinet process. Cabinet does not make the appointments but, by convention, the Minister of
Education informs their Ministerial col eagues by submitting a paper about their intentions to the
Appointments and Honours Committee. Once Cabinet has received a Minute from the Committee,
the Minister of Education signs a letter of appointment.
Therefore, to answer your questions:
1. There is not a list of vacancies for Ministerial appointments. Rather, there is a list of
Ministerial appointments which are to be considered this year. This list is attached as
Appendix A.
2. There is no formal or specified nomination period. The TEC engages with the Minister, the
Chair of the council and nominating agencies as and when appropriate in advance of making
appointments in a timely fashion. This includes taking into consideration other factors that
impact on timing of decisions, such as the ‘period of restraint’ which means appointments
are not made in the three months prior to a general election.
3. It is not the role of the TEC to advertise the Ministerial appointments where we provide
advice to the Minister; therefore, we do not have any method of advertising, nor do we
receive ‘applications’.
If you wish to be considered for appointment to a TEI council, I suggest you write to the Minister’s
Office at Parliament stating the council for which you wish to be considered or the individual
Chancellor or Chair of said council, and how you meet the requirements in the Skil s Framework on
the TEC website.
You have the right to seek an investigation and review by the Ombudsman of this response.
