INFORMATION REQUEST – Allegations against Marty Grenfell
We  write  in  response  to  your  email  dated  3  November  2022  in  which  you  requested  the
following information:
 I kindly request any and all communications, meeting notes etc regarding
TCC  CEO  Marty  Grenfell  and  alleged  abuse  behaviour/sexual  harrassment
towards Farm Street Association Chairman Jon Jenner during or after 2019
and any related investigations.

We have considered your request in accordance with the Local Government Official
Information and Meetings Act 1987 (“LGOIMA”) and the Privacy Act 2020 and respond as
follows:
The matter of the complaint and subsequent investigation is an employment matter between
the Chief Executive Marty Grenfell and the Tauranga City Council.  We can advise that a
complaint was made about the Chief Executive and as a result an independent investigation
by an external party was commissioned. The outcome of the investigation was the complaint
was unfounded. We note there has been no allegation of sexual harassment made by Mr
Jenner.
The information you request is refused under the following sections of the Privacy Act and
LGOIMA:
The Privacy Act 2020 Information privacy principle 11
1) An agency that holds personal information must not disclose the information to any
other agency or to any person
The LGOIMA:
Section 17 Refusal of Requests
a)  That, by virtue of section 6 or section 7, there is good reason for withholding the
information
Section 7 Other reasons for withholding official information

 (2) subject to sections 6, 8, and 17, this section applies if, and only if, the
withholding of information is necessary to:

7(2)(a) protect the privacy of natural persons, including that of deceased
natural persons

o
(f)(ii) maintain the effective conduct of public affairs through the protection
of such members, officers, employees, and persons from improper
pressure or harassment.
