Thank you for your request under the Official Information Act 1982, originally sent  to  the 
Department of the Prime Minister and Cabinet on 29 September 2022, for: 
Can you please provide a copy of the Memorandum of Cooperation between the NZ 
Government and the EPA of the State of California. 
Can you also provide: 
Legislative authority by which the MOC was entered into 
Cost / Benefit analysis associated with the MOC  
Analysis of the MOC and reports and recommendations associated with partnering 
with California –  
Unintended consequences on New Zealanders - poverty? 
As you will be aware, on 14 October 2022, your request was transferred in full to the Ministry 
for the Environment (the Ministry) as it was believed that the information you requested was 
more closely connected to the functions of the Ministry. It has since come to light that the 
Ministry of Foreign Affairs and Trade (MFAT) is better placed to respond to your request. As 
such, we have transferred your request  in full  to  MFAT.  In these circumstances, we are 
required by section 14 of the Official Information Act 1982 to transfer your request. 
You will hear further from MFAT concerning your request.  
You have the right to seek an investigation and review by the Ombudsman of this decision to 
transfer.  Information about how to make a complaint is available at
