Dear Kahurangi
I refer to your Official Information Act 1982 request dated 15 September 2022 for
information about providing driver’s license to Police.
Specifical y, you requested.
For those travel ing on the road, what is the procedure when forced by police to
provide a driver's license.?
We request a record providing the police procedure and process for the safety of
travellers
Section 5(4) of the Land Transport Act 1998 sets out the requirement that a person
driving a motor vehicle must produce without delay his or her driver licence for inspection
whenever required to do so by an enforcement officer.
Section 31(1)(c) of the Land Transport Act 1998 creates an offence if the person is a
driver of a motor vehicle and fails to produce his or her driver licence for inspection
without delay after being required to do so by an enforcement officer. A copy of the Rule
is available to view here:
https://www.legislation.govt.nz/act/public/1998/0110/latest/whole.html#DLM434636
Accordingly, it is expected that in the ordinary course of events, a driver wil carry their
driver licence with them whenever driving and be able to readily produce it when
required. Police enforces the Land Transport Act 1998 in good faith and in consideration
of the underlying spirit and intention of the law.
I trust this information is satisfactory in answering your request.
Yours sincerely
Superintendent Steve Greally
