INFORMATION REQUEST – Contracts held by Bay Venues Ltd, Airport, Marine Precinct
and facilities.

We write in response to your email dated 12 October 2022 in which you requested the
following information:
all contractor agreements/contracts with the listed entities. For example, if Bay
Venues has a cleaning contract with a local business - that contract between
the council and that cleaning business is what I request.

The listed entities in your original request were:
- Bay Venues
- Beachside Holiday Park
- Trust Power Baypark
- Tauranga Airport
- Marine & Boating Facilities

On 13 October 2022 we asked you to refine your request and you advised that you sought
the contracts for:
- Bay Venues Limited
- Tauranga Airport
- Marine & Boating Facilities

We have considered your request in accordance with the Local Government Official
Information and Meetings Act 1987 (“LGOIMA”) and respond as follows:
Status of activities
For clarity, we note that Bay Venues Limited is a Council Controlled Organisation.
Tauranga Airport, the  Marine Precinct and Marine Facilities are not Council
Controlled Organisations, rather internal council activities.

Decision to charge
We estimate that your request covers approximately 34 contracts for services that
are held for Bay Venues, the Airport, Marine Precinct and Marine Facilities.
Responding to your request will require significant staff time, and we will need to
charge for this. We estimate your request involves one hour and ten minutes of staff
time spent retrieving, reviewing, redacting and peer reviewing each contract. Council
time is charged at $38 per half hour.  The indicative charge for 34 contracts is
$2,926.00.
We also note that the nature of your  request is such that we anticipate significant
information you seek may be  commercially sensitive, and potentially withheld under
LGOIMA. We will also need to consult with each of the contracting parties about any
potential release of information from these contracts.
Before we proceed further with your request, please confirm your agreement to the
meet our charge for your request by 2 November 2022. The council will require
payment in full before providing any requested information. Any unused component
of the charge will be refunded to you.

You may want to reconsider the scope of your request again. If there are agreements
covering specific services, or with specific entities that you want, please let us know,
