I refer to your email dated 15 August 2022, requesting the following information under the 
Official Information Act 1982 (the Act): 
 
“I request the following in regards to smart speed cameras throughout New Zealand. 
Documents released as referenced in the article linked below. 
How many are in planning. 
Locations of all planned smart speed camera locations (both point a and b of the 
camera). 
Any documents/plans in relation to issuing demerit points from a speed camera. 
Estimated profits.” 
 
Waka Kotahi NZ Transport Agency (Waka Kotahi) partially transferred your request to Te 
Manatū Waka Ministry of Transport (Te Manatū Waka) on 5 September 2022. We are 
responding to your request for “any documents/plans in relation to issuing demerit points 
from a speed camera”. You can expect a separate response to the rest of your request from 
Waka Kotahi. 
 
For this request, we have interpreted “documents/plans” to refer to formal advice through 
briefings or reports.  
 
There are six documents that fall within the scope of your request. These documents, where 
we have released their titles, are listed in the document schedule attached as Annex One. 
Te Manatū Waka is withholding all the documents, apart from four document titles, under the 
following section of the Act: 
 
 
9(2)(f)(iv) 
“to … maintain the constitutional conventions for the time being which 
protect … the confidentiality of advice tendered by Ministers of the 
Crown and officials …” 
 
I am satisfied that the reasons for withholding the information at this time, are not 
outweighed by public interest considerations that would make it desirable to make the 
information available.  
 
You have the right to seek an investigation and review of this response by the Ombudsman, 
in accordance with section 28(3) of the Act. The relevant details can be found on the 
Ombudsman’s website: www.ombudsman.parliament.nz
