Official Information Act Request
Our Ref: OIA353/1
1.
I refer to your email of 11 July 2022 in which you request information on “the
pay scales that are attainable as a Crown Law prosecutor”. Specifically “the
various pay scales for Level 1, 2, 3 and 4 Prosecutors and any other pay scale
information.”
2.
While Crown Law funds Crown prosecutions, it does not employ any prosecutors.
Crown prosecutors are employed by private firms at which a Crown Solicitor is a
partner. There are currently 16 Crown Solicitors appointed for 17 regions around
the country. A list of the Crown Solicitors and their contact details are available
on the Crown Law
website. Crown Law does not hold remuneration information
about prosecutors employed by Crown Solicitor firms.
3.
The information requested is therefore refused under section 18(e) of the
Official Information Act 1982 (OIA).
4.
Your reference to the level 1, 2, 3 and 4 prosecutors appears to relate to a
previous version of our classification framework for in-house prosecutors at
other governments agencies who conduct non-Crown prosecutions. This
framework exists as part of the Solicitor-General’s oversight function and does
not relate to the remuneration of prosecutors by the prosecuting agencies.
5.
While I am unable to provide details of how much prosecutors are paid, I can
advise the rates a Crown Solicitor can charge out at for work on criminal
prosecutions on instructions from government departments. The current hourly
rates based on the level of Crown prosecutor are:
• Principal prosecutor $309;
• Senior prosecutor $260;
• Intermediate prosecutor $208; and
• Junior prosecutor $151.

You have the right, by way of complaint to the Ombudsman under section 28(3)
of the OIA, to seek an investigation and review of our decision on your request
for information.
Proactive release
7.
Please note that we may publish this response (with your personal details
redacted), and any related documents, on Crown Law's website if we decide
proactive release of this information is or may be in the public interest. If you
have any concerns about this, please let us know within 10 working days of the
date of this letter.
