Hi Alister,
I just spoke with the Minister’s political adviser, Ben McLachlan. Ben was Kiri Allan’s adviser and is continuing in this role
for Ayesha Verrall as Acting Minister.
Ben’s understanding was that DOC was going to send a letter of response to TCC - he imagines this is what the letter you
forwarded was.
He says the guts of it is that the Minister cannot review the previous decision but can consider a fresh one. This is Crown
Law advice, which may be what the note on Crown Law in that letter referred to. This is something of a hard barrier –
Ministers will be extremely reluctant to go against Crown Law advice, as you can imagine.
It sounds like the Council will have to rerun the process and then a fresh application can be considered by the
department.
This would not be called in for a Ministerial decision automatically, but would likely by dealt with by DOC locally. The
general view in the Beehive is not to call in decisions unless they feel they need to. Regardless, if past experience is
anything to go by Labour Ministers are unlikely to be a problem.
