We refer to your official information request dated 6 May 2022 for information about the lease 
agreement between Hutt City Council and the Maungaraki Community Association relating to  
the Maungaraki Community Centre.  Specifically, you have asked: 
Could you please advise how much the Maungaraki Community Association has paid 
to the Hutt City Council for each of the past ten years under the 50% profit share 
provision of the lease for the Maungaraki Community Centre? Please also forward me 
all correspondence the Council has had over the past ten years with the Association 
on the particular matter. 
 
By way of context, the Maungaraki Community Centre is owned by the Hutt City Council.  It is  
leased to Maungaraki Community Association for $100 per annum or for half the amount by 
which the Maungaraki Community Centre’s income exceeds its expenditure in each preceding 
financial year, whichever is the greater amount.  However this is subject to negotiation based 
on the Maungaraki Community Association’s annual report of its operations. 
 
Hutt City Council has invoiced Maungaraki Community Association the following amounts over

The Maungaraki Community Centre was leased to Maungaraki Community Association for 
$100 per annum or thereabouts.  Accordingly, your request to be provided with 
correspondence relating to lease of the Community Centre for above $100 (ie. under the profit 
share option of the lease) is refused under section 17(g) of the LGOIMA, as the information 
requested is not held by Hutt City Council and we have no grounds for believing that the 
information is either— 
i. 
held by another local authority or a department or Minister of the Crown or 
organisation; or 
ii. 
connected  more  closely  with  the  functions  of  another  local  authority,  or  a 
department or Minister of the Crown or organisation:
