Response to your official information request
Thank you for your official information request for details of who is grazing the former
NZDF land on Watts Peninsular, what the terms & conditions of that grazing are, and the
number of cows on the land, that was lodged with NZDF. As advised, your request was
transferred to Toitū Te Whenua on 19 January 2022.
Details of who is grazing the land are withheld under section 9(2)(a) of the Official
Information Act to protect the privacy of the individual.
The terms and conditions of the grazing are the standard grazing licence terms being:
• A term of 12 months commencing on the date the “Licence to Occupy” (LTO) is signed
by both parties unless sooner determined under any of the provisions contained in the
LTO (current LTO from 1 November 2021);
• LTO is for the purposes of grazing over the Land to be accessed from Nevay Road and
Shelly Bay Road;
• The LTO is not transferable – cannot be assigned, sublet, mortgaged, changed, or
otherwise disposed of;
• The Licensee:
o wil use and manage the Land in a good and husband-like manner and not
impoverish or waste the soil;
o wil not break up or crop any part of the Land, nor cut down any trees or bush
or remove or change any of the existing gates and fencings without prior
consent of the Licensor;
o wil not erect any buildings or make any improvement on the Land without prior
consent of the Licensor;

o wil maintain al buildings, fences, gates, drains and other improvements within
the paddock boundaries in good order, condition, and repair including keeping
any gates locks and fences secure around the accessways.
o If the Licensee wishes to surrender the LTO they must provide one months’ prior
written notice to the Licensor;
o Right of access is restricted to use for pedestrian access/security lighting/smal
non-commercial vehicles and smal farm vehicles. No heavy or commercial
vehicles (other than Stock trucks from Nevay Road) without prior written
consent of the Licensor;
The number of cows on the land fluctuates during the year. However, on average there are
15 cattle on the land being a mixture of cows and calves.
