Dear Mr Innes
Thank you for your email of 8 December 2021 to Te Tūāpapa Kura Kāinga - Ministry of
Housing and Urban Development requesting the following information under the Official
Information Act 1982 (the Act):
Please provide all information relating to the validation of loans under Kāinga Ora–
Homes and Communities Act 2019, Subpart 4—Other provisions about Kāinga
Ora–Homes and Communities Section 15 Loans deemed to have been lawfully
raised.
Include all details as to from whom the loans were obtained.
Please confirm whether the loans had any connection to the Belts and Roads
Initiative.
On 13 January 2022 your request was transferred to Kāinga Ora – Homes and
Communities under section 14 of the Act.
On 14 January 2022 we contacted you to explain that your request was very broad and
not specific to the kinds of loans you are referring to that are covered under the Kāinga
Ora – Homes and Communities Act 2019, subpart 4, section 15. We provided descriptions
of the kinds of loans we have, and links to publicly available information. However, you
declined to refine or clarify your request.
Information related to each type of loan could include a wide variety of internal and
external communications, policies, updates, and other related documents that may fall
within scope of your request. In addition, Kāinga Ora does not maintain detailed records of
financial institutions or wholesale investors that hold our bonds and bil s at any point in
time. These debt instruments are negotiable and are bought and sold by financial
institutions or wholesale investors regularly on the secondary market.
For the reasons described above, I am declining the first two parts of your request under
section 19(f) as
“the information cannot be made available without substantial collation or
research”.
With respect to the third part of your request, I can confirm that Kāinga Ora loans have no
connections to the Belts and Roads Initiative.
You have the right to seek an investigation and review by the Ombudsman of this
