Thank you for your request dated 18 August 2021 to Kāinga Ora – Homes and Communities
requesting the following information under the Official Information Act 1982 (the Act):
“a copy of the recent Upper Hutt City Council application to the Infrastructure
Acceleration Fund Expression of Interest for funding to construct a road/infrastructure
corridor on the Silverstream Spur”.
As previously advised, Kāinga Ora is the funding provider under the Infrastructure
Acceleration Fund. Whilst Kāinga Ora is responsible for assessing applications, we do so
against key criteria, taking into consideration cost-effectiveness and the contribution of
applicants, as well as capability and readiness. Kāinga Ora does not have responsibility for
the decisions taken by Councils on the projects for which they apply for funding.
The terms and conditions of the Expression of Interest (EOI) for applications for funding
assistance through the IAF outline that all proposal information Kāinga Ora receives will be
treated as confidential information and would not be shared with any third party for any
purpose other than to complete an evaluation.
The EOI application from Upper Hutt City Council is currently subject to evaluation and has
been provided in confidence. I am therefore refusing your request under Section 9(2)(ba)(ii)
of the Act to
protect information which is subject to an obligation of confidence. The public
interest in this information does not outweigh the need to withhold it.
Should you have concerns about the project we would recommend you approach Upper Hutt
City Council directly.
You have the right under Section 28(3) of the Act to seek an investigation by the
