Thank you for your OIA request dated 8 August 2021 to the Department of Internal Affairs
(Department). You requested –
“
On 3 October 2016 a new requirement was inserted into the Gambling Act at section
110(4B), which says:
“(4B) A corporate society must, in accordance with the regulations, provide the
Secretary with an electronic version of every statement published under
subsection (4).”
This request is made for a copy every such statement provided to the Secretary, since
the Act was thus amended. I further request that the information be provided to me
exactly as it was provided to the Secretary (i.e., as a copy of the original "electronic
version").”
Response to your request
Section 110(4) provides that the specified grants information that must be published at least
annually and s.110(4B) provides that – “A corporate society must, in accordance with the
regulations, provide the Secretary with an electronic version of every statement published
under subsection (4)”.
In the absence of any regulations specifying how and when corporate societies should supply
electronic versions of their published grants statement to the Department, societies do not
have to provide that information directly to the Secretary. The Department therefore does
not have the information requested.
Corporate societies still have to comply with section 110(4) by publishing grants information
at least annual y and with the Gambling (Net proceeds) Regulations 2004 by making that
information available on the societies’ websites. You are able to obtain the information
requested by sourcing it from each corporate societies' website. Your request for this
information under the OIA is therefore refused in reliance on section 18(d); the information
is publicly available.
