Official Information Act 1982 request 

 
Thank you for your Official Information Act 1982 (OIA) request of 2 March 2021 to the Ministry of Justice 
(the Ministry) regarding private prosecutions. Your request was for the following: 
 
1.  All documents, manuals or reports regarding private prosecutions in New Zealand; and 
2.  Anything that helps citizens understand the process of how to proceed with a private 
prosecutions 
 
In response to part 1 of your request, the information you request does not exist. We have consulted the 
Ministry Research and Evaluation team and the Ministry Library who advise the Ministry has not produced 
“documents, manuals [and] reports regarding private prosecutions in New Zealand.” Therefore, I am refusing 
this part of your request under section 18(e) of the OIA. 
 
In response to part 2 of your request, information that “helps citizens understand the process of how to 
proceed with private prosecutions” is publicly available on the Ministry website. Therefore, I am refusing this 
part of your request under section 18(d) of the OIA. You may access this information at:

I have also enclosed news articles which provide information on private prosecutions at Appendix 1.
