Dear Amy,
I refer to your Official Information Act (OIA) request dated 1 July 2020 in which
you requested the following:
Request 1:
I respectful y request the total number of Trespass Notices issued to members of
the public for each DHB, of which the NZ Police were given a copy between 1
June 2015 and 1 June 2020.
Request 2:
I respectful y request the total number of Trespass Notices issued to members of
the public for each DHB, of which the NZ Police were given a copy between 1
June 2015 and 1 June 2020, and in which the individual has been banned from
access to the DHB with the only exception being Emergency Services (e.g., no
exception listed for attending scheduled medical visits, visiting hospitalized
whanau, etc).
Request 3:
I respectful y request the total number of Trespass Notices issued to members of
the public for each DHB, of which the NZ Police were given a copy between 1
June 2015 and 1 June 2020, and in which there had been no reason given to the
individual prior to the issuance of the Trespass Notice or where there was no
reference to the reason provided on the Trespass Notice.
Police do not produce statistics on ‘Trespass Notices issued to members of the public
by DHB’. Therefore, your request is refused under section 18(g) of the OIA as the
information is not held.
I regret that on this occasion it has not been possible to provide the information
you have requested.
You have the right to ask the Ombudsman to review my decision if you are not
satisfied with Police’s response to your request.
