Thank you for your information request dated

You asked for the following
information:
•
I request all information regarding funding, contracts, communications, applications
for funding, contracts, provision of services and all other matters, made to Te Puni
Kōkiri and all of its subsidiaries to an organisation known as Whānau Ora
Commissioning Agency (formerly Te Pou Matakana).
•
I further request all information held by Te Puni Kōkiri and all of its subsidiaries
regarding John Tamihere, Merepeka Raukawa-Tait, Tariana Turia, Mason Durie,
Pahia Turia, Robin Hapi, Tatiana Greening, Suzanne Snively and Tureia Moxon.
Your request has been considered in accordance with the Official Information Act 1982
(the Act).
On 14 Hui-tanguru 2020 you were notified of an extension of the timeframe for responding
to your request, to Rāmere 27 Poutū-te-rangi. The extension provided additional time to
identify and collate the substantial information that was potentially in scope of your
request. This letter is to notify you of my decision in accordance with the Act. The
documents we are releasing wil be provided as soon as is practicable. Due to closure of
our offices and staff working from home, our ability to finalise the information we are
releasing has been impacted. We anticipate providing you with the documents within 5
working days of our offices reopening.
Your request has been broken down into two parts based on the two bullet points outlined
above. Your request for “all information” related to both parts of your request is extremely
broad in scope, such as to render it impracticable. Te Puni Kōkiri does not centrally collate
“all” information by topic. An initial document search identified over 23,000 documents
potentially in scope of the Part One of your request, and some 69,000 items including
emails potentially in scope of the Part Two of your request. For this reason, our response
focuses on key documents that are at hand, and that are specifically related to the
application for funding or the provision of funding to the Whānau Ora Commissioning
Agency (formerly Te Pou Matakana). We have also provided some contextual information
for your information which relates to the history of Whānau Ora, funding, and funding
models.
With regard to Part One of your request, the following background information about how
Whānau Ora funding is channelled may be of interest to you:
Establishment of the commissioning approach
In mid-2013 Whānau Ora transitioned to the Whānau Ora commissioning approach which
enabled funding decisions to be made closer to the communities being serviced. Under this
approach, the focus was moved away from Government departments and gave greater
attention to building capability within communities and encouraging local solutions to meet
the needs and aspirations of whānau. After a procurement process, three commissioning
agencies were selected to implement the Whānau Ora commissioning approach with Māori
and Pacific whānau across Aotearoa. Further information about the rationale for this can be

The funding process
The role of the commissioning agencies is to provide funding to local organisations within
their designated area, with a focus on developing whānau capability and achieving agreed
outcomes. Funding for the commissioning agencies includes payments for one-off
establishment costs, support for operating costs and commissioning funds. The
commissioning agencies decide how this funding is allocated and the process for whānau to
apply.
The funding recognises the significant benefit delivered to whānau and the cost-effectiveness
of this form of intervention. The contracts with commissioning agencies for all Whānau Ora
funding include performance indicators, and a regular schedule of reporting on the results
achieved across these indicators. There is ongoing review of progress towards results, as
well as efficient administration of funds through quarterly reports. Commissioning agencies
are accountable to Te Puni Kōkiri (the contracting agency) for its investments as a
commissioning agency.

With regard to the information you have requested, as noted above, key documents in
scope of Part One of your request have been identified. These documents provide a
substantive overview of funding decisions since the inception of Whānau Ora
commissioning. They include the formal documentation commissioning agencies are
required to provide to Te Puni Kōkiri, and formal written advice provided by Te Puni Kōkiri
to the Minister for Whānau Ora.
The documents and my decisions with regards to the release of the information are set out
in the table attached as Appendix A. Some information has been withheld in accordance with
the Act on the following grounds:
• Section 9(2)(a) protect the privacy of natural persons, including that of deceased
natural persons;
• Section 9(2)(b)(i ) which protects information where the making available of that
information would be likely unreasonably to prejudice the commercial position of the
person who supplied or who is the subject of the information;
• Section 9(2)(ba)(i) protect information which is subject to an obligation of confidence
or which any person has been or could be compelled to provide under the authority
of any enactment, where the making available of the information would be likely to
prejudice the supply of similar information, or information from the same source, and
it is in the public interest that such information should continue to be supplied;

• Section 9(2)(ba)(ii) protect information which is subject to an obligation of confidence
or which any person has been or could be compelled to provide under the authority
of any enactment, where the making available of the information would be likely
otherwise to damage the public interest;
• Section 9(2)(f)(iv) maintain the constitutional conventions for the time being which
protect the confidentiality of advice tendered by Ministers of the Crown and officials;
• Section 9(2)(g)(i) maintain the effective conduct of public affairs through the free and
frank expression of opinions by or between or to Ministers of the Crown or members
of an organisation or officers and employees of any department or organisation in the
course of their duty;
• Section 9(2)(i) enable a Minister of the Crown or any department or organisation
holding the information to carry out, without prejudice or disadvantage, commercial
activities;
• Section 9(2)(j) enable a Minister of the Crown or any department or organisation
holding the information to carry on, without prejudice or disadvantage, negotiations
(including commercial and industrial negotiations).
In making the decision to withhold information, I have considered the public interest
considerations in section 9(1) of the Act.
13 documents have been declined under section 18(d) of the Act, which applies when the
information is publicly available. As indicated in a previous response to you on 26 Hui-tanguru
2020, the annual reports for each agency are publicly available on their respective websites
and copies of the annual budget confirmation letters have previously been released by Te
Puni Kōkiri on the Te Puni Kōkiri website here:

The remainder of your request, for “all” information related to the topics you have noted in
Part One of your request, is declined under section 18(f) of the Act which applies when the
information cannot be made available without substantial collation and research.
With regard to Part Two of your request, as noted above, a large amount of information was
identified potentially in scope of this part of the request. In particular, I note that as a previous
Member of Parliament and Minister of the Crown, an initial scoping exercise identified 22,000
items regarding Dame Tariana Turia held in our document management system. Because of
the amount of material potentially in scope of this part of your request, our response has
focused on funding provided to the Whānau Ora Commissioning Agency, formerly Te Pou
Matakana.
Four further documents have been identified in scope of this part of your request that are not
captured within Part One of your request. The documents and my decisions with regards to
the release of the information are set out in the table attached as Appendix B.
Some information has been withheld in accordance with the Act on the following grounds:
• Section 9(2)(f)(iv) maintain the constitutional conventions for the time being which
protect the confidentiality of advice tendered by Ministers of the Crown and officials.

considerations in section 9(1) of the Act.
The remainder of your request, for “all” information related to the individuals you have named
in Part Two of your request, is declined under section 18(f) of the Act which applies when the
information cannot be made available without substantial collation and research.
Documents released to you represent the investment approaches and priorities of the
Whānau Ora Commissioning Agency (formerly Te Pou Matakana) and Te Puni Kōkiri at a
single point in time. Some information in these documents may now be out of date and no
longer reflect current priorities and approaches. For a more current overview of
commissioning agency activities, I suggest you refer to the progress updates available on
the Te Puni Kōkiri website.
As outlined above, due to the very broad framing of your request, our response to both parts
of your request has focused on information related to the provision of funding to the Whānau
Ora Commissioning Agency (formerly Te Pou Matakana). We have also endeavoured to
