Thank you for your email of 2 September 2019 to the Ministry of Business, Innovation and Employment
(the Ministry) requesting, under the Official Information Act 1982, the following information:
Most of the professional body has it's board and governance, e.g. Plumbers, Gastfitters and
Drainlayers Board. I would like to know does IAA has the similar structure? If not, does IAA
intend to have it in the future? Also, please send me any discussion papers/memos in relation
to this matter. If it has never been discussed in the past, please treat this as a public
submission and bring it to the current Licensed advisers reference group for their discussion.
The Immigration Advisers Authority (the Authority) is established under the Immigration Advisers
Licensing Act 2007 (the Act). The Authority is headed by an independent Registrar, who is appointed by
the Chief Executive of the Ministry of Business, Innovation and Employment. The Act also establishes the
Immigration Advisers Complaints and Disciplinary Tribunal.
The Authority is not a policy making body, so does not have a role in considering or recommending
changes to the regulatory framework, i.e. to consider establishing a board. As such, your request for any
discussion papers/memos is refused under section 18(e) of the Official Information Act 1982 as this
information does not exist.
The Authority does run a Licensed Adviser Reference Group (the group). The terms of reference for the
group are available
here. Please note that the purpose of the group does not include developing or
considering policy options, however I will share your request with the group for their information.
You have the right to seek an investigation and review by the Ombudsman of this decision. Information
