We have been getting a number of requests for the hearing recordings, so I have included that in
below. There is a risk that it will generate some OIA’s and criticism of a non-transparent process
continuing.

PROCESS FROM HERE:
I want to thank everyone for attending the hearing over the past four days. We have found it
the 
very insightful and have allowed all submitters seeking to be heard, the opportunity to do so,
even when some of the points were not in scope for us to consider.  We will have some clear
recommendations to put through to the Decision Maker as a result.
 
I particularly want to thank iwi partners who have been present to speak to their concerns as

I also want to thank the applicants who have made themselves present at stages during the
process.
 
So, from here…...
 
It is yet to be confirmed whether the Minister of Conservation will delegate this decision to the
Released 
Department to either the Director-General or a Deputy or whether he in fact makes the decision
himself.
 
As Hearing Chair (as the Director-Generals delegate) along with input from the hearing panel
members, I will prepare what is called an Objection or Submissions Recommendation Report and
this will be forwarded to the Decision Maker.
 

The Recommendation Report makes recommendations on the objections or submissions
received and the extent to which they should be allowed or accepted pursuant to section 49(2)
(d) of the Conservation Act 1987.
 
The Decision Maker will consider the recommendations before deciding whether or not to
proceed with the proposal (section 49(2)(e)).
If it is decided to proceed with the proposal, a Decision Makers Report will be prepared for the
Decision Maker to make a decision on the application. This report will include all the statutory
tests which must be met before a decision can be made.
 
Following this, the decision and the relevant reports will be put on the DOC website on the sameAct
page as the notification and hearing information.
 
 
I anticipate that the Objections and Submissions Recommendation Report should be completed
by Friday, 15 March 2024 (earlier if possible). As part of the Decision Maker’s role, they will
decide whether to release this report and when that will occur. If the decision is to release the
report, the Department will advise all submitters of this and provide a link to it.
 
A few of you have requested a copy of the recorded hearings. The purpose of these recordings is
Information 
for administrative purposes only and is not intended to be a publicly available resource. At this
stage, my decision is not to release these recordings.
 
Thank you again for your time and thank you to the panel and support staff including the

Clint, from what I understood you were asked to be on the hearings panel because of your
extensive local and recreation industry knowledge and the context of the DOC Regulatory
environment that you experience in your Board role, rather than specifically because you
are on the Board. 
I know that the Board Support Officer is working on collating feedback from the Board Act
today, so from that perspective I think the process is OK. I don't think there is a need to
revise the TNPMP, but maybe that thinking will be shared in the Cons Board feedback for
us to consider?

We have six OIA requests on hand (and counting) for records of the recent PTL concession
hearings – some have requested the video files, and some have requested transcripts.
 
Information 
To deal with these and reflecting the advice that there’s no clear basis to withhold the
recordings, we intend to publish just the extracted audio of the hearings, packaged into each
day, alongside the PTL submissions on the DOC website. This mitigates the privacy aspect of
having people’s faces on video out there, and also reflects that the teams generated transcript
isn’t accurate or complete, and we haven’t created a separate transcript.

There’s about 17 hours of audio, with periods of no sound where there were pauses etc. I
haven’t listened to all of it, so we’d be relying on the fact that privacy interests are mitigated by
the hearings being public and that we advised the hearings were being recorded.

copies rather than the internal SharePoint documents so that you can both access, but
this means any comments or edits you make won’t be in the master document.  Please let
me know if you have feedback – I’m still waiting to have a conversation with our legal team
with regard to the correct allow/accept criteria for some of the submission points made by
Treaty Partners.  These are highlighted in the spreadsheet in yellow – purely to make them

easy to find when I have that discussion.
