Official Information Act request
Thank you for your email of 6 May 2023 to Corrections regarding information relating to
breaches of electronic monitoring conditions. The below questions were transferrred to
Police and then to the Ministry of Justice (the Ministry) for a response on 28 June 2023.
Your request has been referred to me, as it falls within my responsibilities and is being
managed in accordance with the provisions of the Official Information Act 1982 (the Act).
Specifically, you requested:
1) In the 3 months of 2021, September, October, and November:
- how many times was a prosecution launched for a breach of bail, parole or other
form of breach such as a parole recall, resulting from failures to charge [the
equipment]?
2) In the 3 months of 2022, September, October, and November:
- how many times was a prosecution launched for a breach of bail, parole or other
form of breach such as a parole recall, resulting from a failure to charge trackers?
The Ministry has interpreted your request to be for the number of prosecutions filed for
breach of bail, parole or other forms of breach, where the breach was caused by a failure to
charge electronic monitoring equipment.
Please note the Ministry reports on finalised charges which are charges that have received
an outcome through the court process. The Ministry does not report on prosecutions.
In response to your request, I can advise that the Ministry does not hold the information you
have requested. Data on criminal offending is based on offence codes and there is no
offence code for the information you have requested.
I am therefore refusing your request under section 18(g)(i) of the Act as the information
requested is not held by the Ministry and I have no grounds for believing it is held by another
agency subject to the Act.
