I would like to request the following information under the OIA:

* Does your agency use social media monitoring tools or services such as Signal, ZeroFOX or Geofeedia? If so, I'd like to know which tools are used, where they are installed / used from, (broadly) what they are used for, and how much they cost (both to install / purchase, and per year for licencing / subscription / support).

I would prefer to receive an electronic response. Queries about
this request will be automatically forwarded to me by the
fyi.org.nz website.

With regards to s12 of the OIA, I am an NZ citizen and in NZ.

I refer to your Official Information Act request of 27 May 2016. You asked
does your agency use social media monitoring tools or services such as
Signal, ZeroFOX or Geofeedia? If so, [you] would like to know which tools
are used, where they are installed/used from, (broadly) what they are used
for, and how much they cost (both to install/purchase, and per year for
licencing/subscription/support).

 

Pursuant to section 15A of the Official Information Act 1982, I have been
asked to advise you of the requirement to extend the time limit to respond
to your request. The period of the extension is until 25 July 2016.

 

The reason for the extension is that the time required to research and
collate the requested information and the consultations necessary to make
a decision on the request are such that a proper response cannot
reasonably be made within the original time limit.

 

You have the right, under section 28(3) of the Official Information Act
1982, to ask the Ombudsman to investigate and review my decision to extend
the time limit for deciding upon your request.

Dear SEDGWICK, Alexandria,

Thankyou for your response to my recent OIA request. I note that you have withheld information on pricing of these tools as it is "private information between the suppliers of the service and the New Zealand police". This does not appear to be a legitimate OIA withholding ground. Could you please inform me of the legal basis for the withholding of this information?

Also, you should check out the Ombudsman's recent guidance on the public interest.

Of particular interest is the section on "transparency" on page 10, and accompanying case examples. Case study 175789 makes it clear that "As a general rule, the identities of contractors awarded public sector contracts (whether by tender or not) and the total cost of those contracts should always be disclosed in the public interest. "

If you still wish to withhold this information, then I am quite happy to go to the Ombudsman to force release.

I am responding to your query about an official information response sent
to you by Police. Your comment reads: “I note that you have withheld
information on pricing of these tools as it is ‘private information
between the suppliers of the service and the New Zealand police’. This
does not appear to be a legitimate OIA withholding ground. Could you
please inform me of the legal basis for the withholding of this
information?”.

 

The response should have stated that the information was “withheld under
section 9(2)(b)(ii) where the making available of the information would be
likely unreasonably to prejudice the commercial position of the person who
supplied or who is subject of the information”.

 

Police has noted your further comments about the release of information
about contractors. This Police releases such information on a regular
basis in responses to the select committee and in response to official
information requests.

 

On this occasion, Police believes that s9(2)(b)(ii) is appropriate and
advises you of your right to complain to the Ombudsman about this matter.
