I would like to request all minutes of any briefings held for CCC or its staff or contractors by EQC / MBIE / EAG from 04 September 2010 through 31 December 2012.

To be clear this includes any emails between the domains ccc.govt.nz and domains eqc.govt.nz and dbh.govt.nz and mbie.govt.nz, and individual members of the EAG which may have been sent from their own personal emails. I also request any recorded minutes , notes, agenda, and slides which may have been taken or provided for these briefings.

Thank you for your email, received on 15 August 2018. You requested the
following information, under the Local Government Official Information and
Meetings Act 1987 (LGOIMA):

 

I would like to request all minutes of any briefings held for CCC or its
staff or contractors by EQC  / MBIE / EAG from 04 September 2010 through
31 December 2012.

 

To be clear this includes any emails between the domains ccc.govt.nz and

members of the EAG which may have been sent from their own personal
emails. I also request any recorded minutes , notes, agenda, and slides
which may have been taken or provided for these briefings.

 

Council Response

 

Staff from the Council's Consenting and Compliance Group have looked at
your request.

 

There are a number of inherent difficulties in providing this information
as requested. Following the 2010-2011 Canterbury Earthquake Sequence, the
Council was not operating in a "business as usual" environment, but was
severely disrupted. As a result the relationship between key agencies and
staff at Council, EQC and MBIE were not well tracked or stored as would be
expected in a normal environment. In addition, this would involve a large
number of staff, many of whom are no longer working for the Council. The
only way to access their correspondence would be to retrieve archived
material. The cost of such an exercise is considerable and would not be
reasonable; and the Council could not guarantee there would be any
information relevant to your request. Without meaningful refinement of
your request, staff would not be able to respond to your request without
an unreasonable burden placed on staff time or expense incurred.

 

In the first instance I ask that you refine your request to specific
information. If you are interested in specific guidance or topic, please
specify.

 

To assist, I have included previously released agendas and minutes of the
Consent Operations Working Group. This was a cross agency comprising key
territorial authorities, EQC and CERA looking at rebuild issues in the
wake of the earthquakes.

Dear Official Information,

I would specifically like any interactions surrounding MBIE Guidance Documents, and the development by the EAG. Hugh Cowan refers to briefings to council in a letter dated 08 November 2010, so presumably there was a briefing provided regarding the development of guideline for repair of earthquake damage to residential foundations. Similarly I would like any communication between CCC and members of the Engineering Advisory Group from 04 September through 31 December 2012.

Refinement of request

On 31 August 2018, you refined the scope of your request to the following:

 

I would specifically like any interactions surrounding MBIE Guidance
Documents, and the development by the EAG. Hugh Cowan refers to briefings

Release of information

I have attached any relevant information the Council holds in relation to
your request in the specified timeframe. I have also provided some
information and explanation in my previous correspondence to you.

 

In addition, please note the following comment from staff:

 

As the EAG developed guidance for Canterbury there were several briefings
by the EAG to various stakeholders to inform, educate and to hear
feedback.

Those stakeholders included Waimakariri, Selwyn and Christchurch City
Councils, insurance company representatives,  insurers project management
office staff and members of the architectural and engineering community. 
Some of these briefings were held in the Christchurch City Council offices
and Christchurch City Council although a key stakeholder, was only one
party in a wide audience and did not record in writing, the specific
details of these briefings.

 

The Council has decided to withhold some information under the following
section of the LGOIMA:

-          7(2)(a) – to protect the privacy of natural persons

 

In the Council's view the reasons for withholding these details are not
outweighed by public interest considerations in section 7(1) favouring
their release.
