Dear Sim

I refer to your email received on 5 August 2012 requesting information about the photographing of
council property, and specifically the Auckland Art Gallery.
Generally:
Where photographs are taken externally from public areas, there is no legal power or ability to instruct
this to cease.
Where photographs are taken internally, again, there is no general policy or standing order.
Dependant on the circumstances and location, the person could be asked to desist by staff or security
and to leave the premises under the provisions of the Trespass Act if this was causing concern.
Art Gallery:
The building and forecourt are free to photograph for all purposes.  Within the Gallery, visitors are
allowed to take photographs for personal use.  Tripods and flash are not permitted in any Gallery
spaces.  Photography is not permitted of Māori portraiture, or within most temporary exhibitions.  For
media, commercial or other purposes, an application to film/photograph is available.  Security
personnel and Gallery Guides will remind visitors, should they be unaware or forgetful, and guides
can offer an application form if required.  This information is also available on our website:

If you have any further queries please email [email address] quoting Official
Information Request No. 9000117896.

Yours sincerely
