Re: LUC - 2016 – 1496 for 19-25 Rangiwai Road.
I refer to your email, which we received on 26 September 2016 requesting information about
LUC - 2016 – 1496 for 19-25 Rangiwai Road.
1- What time and date did Local Board Member Greg Prestland receive the Application for
LUC - 2016 – 1496 for 19-25 Rangiwai Road.
The time and date that Greg Presland received the application is not known. It was sent by
James Jackson on 17 August 2016 at 11.35 a.m.
2- Please explain why James Jackson of Auckland City Council initially sent Greg Prestland
a fully redacted application for LUC - 2016 – 1496 for 19-25 Rangiwai Road, instead of the
actual application for LUC - 2016 – 1496 for 19-25 Rangiwai Road
Resource Consents did not send a redacted copy of the application to anybody.
3-What times and date(s) did Local Board Member Greg Prestland review the 19-25
Rangiwai Road Application
Mr Presland has no record of when he reviewed the application.
4- Please provide timesheets to support the above request.

5- On what legal basis did Local Board Member Greg Prestland refuse on three occasions to
provide a copy the Application for LUC - 2016 – 1496 for 19-25 Rangiwai Road to the person
and persons requesting the Application.
Mr Preslad confirms he did not refuse.
6- What was the timeframe provided to Local Board Member Greg Prestland by Auckland
City to review and provide commentary/ feedback on LUC - 2016 - 1496

James Jackson’s first email to Greg Presland and Sharon Davies of the Waitakere Ranges
Local Board was sent on Wednesday 17 August 2016 at 11:35 a.m. and requested
comments in respect of the application by 3:00 p.m. on Thursday 18 August 2016, noting
however that it was an extremely short time for the Local Board to look at the application and
that it was therefore understandable if the submission of comments within that timeframe
was not possible (See attachment 1).
James Jackson then sent a second email to Greg Presland on Monday 22 August 2016 at
9:14 a.m. in reply to an email from Greg Presland dated Monday 22 August 2016 at 9:08
a.m. clarifying that the attachment to the previous email contained a hyperlink for a One
Drive file that contained the full application (see attachment 2).
James Jackson then sent a third email to Greg Presland on Wednesday 24 August 2016 at
1:02 p.m. asking if the Local Board had any comments to make in respect of the application
(see attachment 3). No response was received to this email and resource consent was
subsequently granted on Friday 26 August 2016.
Should you believe Auckland Council has not responded appropriately to your request, you
have the right by way of complaint, under section 27(3) of the LGOIMA, to apply to the
Ombudsmen to seek an investigation and review of the decision.
