Details of actions taken by the Tertiary Education Commission since 2014 to recover funding 
provided to organisations from the Workplace Literacy and Numeracy (WLN) Fund, including 
the organisations affected and the basis for the recovery action undertaken. 
 
The information requested is in the attached table.  The recoveries listed are all business as usual 
recoveries related to delivery levels relative to funding received, and in accordance with the funding 
conditions in place for each year. Note that in some cases the funding recovery was offset against 
final payments to providers.

Notes: 
1.  Recoveries are based on funding mechanisms in place under section 159L of the Education Act 1989. 
2.  If a tertiary education organisation (TEO) receives funding under this funding mechanism that is 
greater than it should have received, the TEO must treat the amount of the over-funding as a debt due 
to the Crown that is repayable on demand, and may be offset against all or any funding or any sum of 
money payable by the TEC to the TEO. 
 
3.  The above recoveries are calculated on the full allocation rather than the actual payment made. This is 
done to enable us to record the recovery in relation to the full commitment for the time period.   
4.  Funding agreements may be varied during the term of the agreement. The TEC varies approximately 
half of all employer-led WLN funding agreements. Typically this is because operational constraints 
means training can't take place as originally planned.
