I refer to your Official Information Act 1982 (OIA) request dated 15 November 2022 for
information relating to traffic management plans for road policing operations, in which you
requested:
What is the TMP the NZ Police use when conducting Roadside Breath tests on
[Horowhenua District Council] controlled roads in the region?
I have interpreted ‘roadside breath tests’ as checkpoints conducted with the purpose of
breath testing motorists.
Where Police operate a checkpoint on a state highway or motorway, where speeds
exceed 80km/h or otherwise identified risks are present, a Waka Kotahi Land Transport
Agency approved site specific Traffic Management Plan (TMP) must be used.
Each TMP is developed and tailored to the specific stretch of road the plan has been
requested for, by independent approved TMP contractors. As there is no general TMP
that covers all roads within a road controlling authority boundary, your request is refused
pursuant to section 18(e) of the OIA because the document does not exist.
If you are not satisfied with the way I have responded to your request, you have the right
under section 28(3) of the OIA to ask the Ombudsman to review my decisions.
