pertinent questions that would be good to answer:
  What policy work has been to date? We would want to understand carefully the rationale for this change
and why this should be prioritised.
  What stage is the project currently at? You mentioned that you had a legal opinion and that there was a
MVP potentially ready to launch early next year – can you confirm your timelines? If I have got this wrong, it
would be good to understand if this work is funded and what the timeline will be.

As mentioned in our meeting earlier, Out of Scope and I are doing some work in the digital identity space, looking at what
changes may be required to the Land Transport Act and Driver Licencing Rule to support the introduction of digital
driver licences. Currently, the Land Transport Act and Driver Licensing Rule prescribe the form and format of driver
licences, and other requirements such as the need to surrender a driver licence in certain circumstances.

Document 9
listing the various legislation that we think will need to be amended, but are hoping to have a chat
with you to explore whether there are any operational fixes that would recognise/support digital driver licences.

I thought a bit more about the issue of Standards overnight…, and I think I need to add that while the ISO/IEC 18013-

1 sets the modern standard for physical driver licence cards (to ensure they contain sufficient security features to
significantly minimise the risk of fraudulent reproduction or alteration after they are issued), there is a separate ISO
Standard for digital driver licences.

ISO Standard for Digital Driver Licences

Waka Kotahi needs to be aware that most countries are already in the process of issuing digital driver licences, and
pressure will come/is coming on Waka Kotahi to do the same as work progresses on the Digital Identity Trust
Framework, and as public expectations increasingly anticipate digital service offerings.

The ISO Standard for digital driver licences is 18013-5. This Standard is key for Waka Kotahi to be aware of because
the introduction of DDL systems and policies in accord with the International Standard provides a secure platform
for international interoperability, meaning one of the benefits for licence holders’ opting in to a DDL will be that
they may be acceptable in international jurisdictions, whereas jurisdictions that are transitioning to DDLs in isolation
of the ISO Standard will miss this opportunity for licence holder benefit. Furthermore, international jurisdictions are
increasingly expecting/requiring that licences relied on for driving locally or internationally can be verified in real

time for authenticity. This means that if Waka Kotahi chooses to issue DDLs in a manner that is inconsistent with the
ISO Standard, it will need to provide a mechanism for verifying its licences in an international context.

Last week Out of Scope and I had a meeting with Out of Scope the chief digital officer, to discuss digital driver licences.
Out of S
has been given priority from the Board to issue digital driver licences and a “MYNZTA” type customer hub, and
indicated to us that her team aims to have a digital driver licence by next year.

Out of Scope  and I have started to scope the legislative change that may be required to verify a digital driver licence as the
legal equivalent of the physical driver licence. Currently, the Land Transport Act and Driver Licensing Rule prescribe

certain circumstances, which in the ordinary meaning cannot be done with a digital driver licence.

We have put together this Options table - refer Attachment 7hat sets out the policy background and different sections of the LTA and

Thank you for your time yesterday to discuss the mDL and consumer hub, and for bringing to light issues that need
to be considered.

d Out of Scope and wanted to follow up with you to let you know our thinking.

1.  We agree that we don’t want overly prescriptive legislation to enable the mDL
2.  Strengthening entry into the DL system e.g. validating identity credentials with their source of issue when
presented at the agent counter to confirm someone is who they say they are.
a.  This issue is currently being considered by Waka Kotahi, particularly by the DLIP workstream. There
are competing interests in this space such as ensuring that we do not make the process of obtaining
a driver licence inaccessible/unreasonably restrictive for some. Section 9(2)(g)(i)

and the memo needs to address that
this risk must be managed. We need good identity management processes, particularly to prevent a
fraudster from obtaining a mDL using someone’s genuine details.Section 9(2)(g)(i)

b.  A person could be granted a unique verification code in order to download their consumer hub
info/mDL. We do not think that this should necessarily involve a consumer going into an agent

counter. However, it could be useful to have a digitally assisted process whereby a consumer can go
to an agent counter to set up their consumer hub, especially if they are elderly, ESOL etc. If possible
there also needs to be a robust self-service process whereby Waka Kotahi can validate a consumer’s
identity online so that they can download the consumer hub/mDL. This will reduce the risk of
the
flooding our agent network and support uptake of the mDL and consumer hub. I think we can
expect a large number of existing licence holders to adopt a mDL and want to make the self-service
process as accessible as possible. In NSW over 50 per cent or 3 million people have adopted a digital
licence. The details of these processes are best left out of this memo and can be handled by the
digital and security experts that will be developing the process and mDL.

3.  Consumers should not hold a mDL and physical DL concurrently. Consumers could have the option of
choosing at the agent counter.
a.  If NZ issues an ISO compliant mDL, there is still a risk that mDLs may not be recognised overseas.
There may also be a slow uptake of mDL recognition within NZ. As such, we think that Waka Kotahi
should continue to issue physical driver licences. Consumers would have the choice to also obtain a
mDL. This mirrors the guidance from Australian states that recommends that licence holders carry a
physical driver licence when travelling interstate. A physical card may also be preferrable in other
instances, for example, if the holder’s phone dies.

I only have a draft version of the standard (attached). The published version is available but costs around $327 NZD
to download, I had meant to find out if Waka Kotahi could purchase this but haven’t had a chance to follow that up.

Regarding signature, the ISO 18013-5 standards says that the mDL (mobile drivers licences) “fulfils at least the same
function as an IDL (ISO/IEC 18013-1) but, instead of being paper or plastic based, resides on a mobile device or
requires a mobile device as part of the process to gain access to the driving licence”. Since ISO 18013-1 guides the
design format and data content, Section 9(2)(g)(i)
