Thank you for your request of 23 March 2022 to the Ministry of Business, Innovation and Employment
(MBIE) requesting, under the Official Information Act 1982 (the Act), the fol owing information:
For the period 26/10 /2017 to 1/2/21

Correspondence to and from Shane Jones or the Provincial Growth Fund or Minster of
Infrastructure or Minister of regional development regarding the Hicks Bay deep water
wharf or Barging or Port.

Correspondence, documents or file notes for East Cape Deep water wharf or Marine
Infrastructure or Barging or Port

Any correspondence from Sir John Clarke to Shane Jones.
On 6 April 2022, you clarified your request is related to the Infrastructure Reference Group “Shovel
Ready” funding, as follows:
I am referring to the Shovel ready funding project provisionally approved by Crown
Infrastructure partners. It was originally listed as" Hicks Bay deep water wharf " and
subsequently annotated by persons unknown to "Marine infrastructure" , The two parties that
were related to the funding besides CIP /Government ministers (IRG) were Te Rimu Trust , (Sir
John and Richard Clarke) and Terrafermah Ltd (Dave Fermah).
This letter is to advise you that your request has been transferred to Crown Infrastructure Partners.
This is because the information you have requested is not held by MBIE. Section 14(b)(i) of the Act
al ows me to transfer any request where the information is not held, but is believed to be held by
another department, organisation or Minister of the Crown.
Please note I am extending the time available to transfer your request, under Section 15(a) of the Act.
This is because consultations necessary to make a decision on the transfer were such that a decision
could not be made within the initial 10 day transfer time limit.
You have the right to seek an investigation and review by the Ombudsman of this decision.
