Dear Cherie,
Thank you for your request to the Ministry of Business, Innovation and Employment (MBIE) of 1 February
2022, requesting under the Official Information Act 1982 (the Act), the following information:
“I would like to request some information about the use of the Criminal Proceeds (Recovery) Act 2009
and the redistribution through the "hypothecated fund" in the eight years since it came into effect.
1. For each of the years 2017-2021, the number of restraint and forfeiture orders that were successful.
2. For each of the years 2017-2021, the money value of restraint and forfeiture orders that were
successful.
3. For each of the years 2017-2021, the money value of restraint and forfeiture orders that were re-
distributed through the "hypothecated fund” to institutions that target the drivers of drug and
organised crime.
4. For each of the years 2017-2021, specifically which government agencies / institutions that target
the drivers of drug and organised crime were successful in their application for this "hypothecated
fund” and approved by Cabinet…”
As advised in my letter of 3 February 2022, questions 3 and 4 of your request have been transferred to the
Ministry of Justice as the information requested is believed to be more closely aligned with the functions
of the Ministry of Justice.
We have interpreted questions 1 and 2 above, which seek information relating to orders that were
‘successful’, as seeking the total volume and value of new orders actually issued each year under the
Criminal Proceeds (Recovery) Act 2009 (CPRA).
The information requested is set out in the table below. The number of new orders includes:
• Restraining Orders (including Variation Orders in a particular case that involves further assets
identified for forfeiture or restraint during the conduct of the case);
• Forfeiture Orders, and

• Warrants that require Police to place assets in the custody and control of the Official Assignee
under section 103 of the CPRA
The figures for value of assets include the total estimated value of assets placed into the custody and
control of the Official Assignee for each year.
