Request made under the Official Information Act 1982
Thank you for your email of 20 September 2021 requesting the following information under the Official
Information Act 1982 (the Act):
date of establishment of the arrangement, and original parties involved
nature and duration of the sharing arrangements, including km of transport corridor and number
of chambers shared.
policies around chamber access and maintenance
ability for competitive providers to access similar arrangements to existing trenches and
chambers
Please provide Waka Kotahi's stance as to whether the transport corridors are now subject to
the Utilities Access Act 2010, and if not, why not.
The agreement was established on 22 June 2000 and was between Transit New Zealand (now Waka
Kotahi NZ Transport Agency) and TELSTRA SATURN LIMITED (now Vodaphone) for a period of 19
years and 364 days. In 2019 the agreement was reviewed by Waka Kotahi and it was determined that
it did not need to be renewed as the provisions were superseded by the Utilities Access Act 2010.
Waka Kotahi granted a licence to TELSTRA SATURN LIMITED to construct the Works within the
Network Infrastructure Arca and thereafter to have access during the term to the licensee's
infrastructure for the purpose of repairing, testing, maintaining, adding to or replacing the whole or
parts of the infrastructure as and when required. The sharing agreement does not provide the
kilometres of transport corridor or chambers shared.
Waka Kotahi has implemented the National Code of Practice for Utility Operators’ Access to Transport
Corridors. Waka Kotahi accommodates access requests on state highways and has entered into case-
by-case commercial agreements.
All Transport corridors are subject to the Utilities Access Act 2010.
