Re: Code of Conduct Investigations 
 
 
Thank you for your email of 29 July 2021 where you requested information regarding Code 
of Conduct investigations.  Your specific request and our response are set out below. 
 
May I please have information on every code of conduct that has been or is being investigated in 
Auckland Council this term 2019 onward. (We note when we asked you to clarify your request you 
specified you were interested in investigations into code of conduct breaches by elected members 
both Council ors and Local Board members). 
 
Current Auckland Council elected members, including the mayor, ward council ors and local 
board members, were elected through the 2019 Auckland Council local elections. All 
successful candidates were officially inaugurated into their representative roles in early 
November 2019. Our response to your request refers only to complaints received from this 
point in time. 
 
You have asked for information regarding investigations into breaches of the Code. A 
complaint will only be referred to as a breach once it has gone through a process of 
assessment and investigation and, as a result, is found to be a breach and has not been 
resolved. Therefore, we are only providing you with information regarding complaints that 
have been through a full process of assessment and investigation and are now complete. 
 
From the beginning of the current term until the date of your request there have been 23 
complaints where either a member of the public, an Auckland Council staf  member, or 
another elected member has made a complaint to the Auckland Council Chief Executive 
alleging that an elected member has breached the Code.  
 
Of those 23 complaints, none were found to constitute breaches of the Code following 
assessment, investigation, and resolution.

However, please see below for further details about the various outcomes: 
 
•  12 were resolved with no further action 
•  2 were resolved through successful mediation 
•  2 were withdrawn by the complainant 
•  1 was resolved through an apology 
•  6 were dismissed on various grounds.

Code, please see Section 4 of the Auckland Council Elected Members Code of Conduct 
2021, which you can access through the Auckland Council website. 
 
Decisions relating to the information that is being released to you were made by Rose

Should you believe Auckland Council has not responded appropriately to your request, you 
have the right by way of complaint, under section 27(3) of the LGOIMA, to apply to the 
Ombudsman to seek an investigation and review of the decision.
