Official Information Act 1982 request
Thank you for your Official Information Act 1982 (OIA) request of 7 May 2021 to the Ministry of
Justice (the Ministry). Your request was for the following:
“…Visiting Justice…rosters (if available) for the 12 months from June 2021 to May 2022…
across all prisons in New Zealand.”
The Ministry creates Visiting Justice rosters at a local level in consultation with the Department of
Corrections, to ensure section 19(4) of the Corrections Act 2004 is complied with. However, I must
clarify that the OIA does not apply to this information as it is considered court information and
courts are not subject to the OIA under section 2(6)(a) of the Act. This is because the courts are
independent of the executive branch of the government.
Therefore, I am refusing your request as allowed by section 18(g)(i) of the OIA as there are no
grounds for believing that the information is held by another department, Minister of the Crown,
organisation, or local authority, subject to the OIA.
