I ask for the following information about dog control measures:

1: How many actions, of what sort, have been taken for breach of section 8C of the Dog Control Bylaw, relating to dogs being required to be on a lead on streets.

2: How many actions, of what sort, have been taken for breach of section 8E of the Dog Control Bylaw, relating to dogs being required to be on a lead in cemeteries.

Context: I see breaches of these two sections every day.

Dear G A Findlay,

 

Thank you for your patience while we consulted further with staff.

 

Please find below a table outlining the number of written warnings and
infringements issued for non-compliances relating to dogs / wandering /
offences while wandering. This information has been collated from a
Council database that records dog control enforcement responses. Please
note the following features of this database:

 

 1. Enforcement responses are categorised by the nature of the
non-compliance (in this case dogs wandering or offences while
wandering). The general location of the non-compliance (e.g. cemetery)
is not flagged. The particular section of the Bylaw or the Dog Control
Act 1996 that may have been breached is also not specified in the
database.
 2. Written warnings are categorised by the primary non-compliance subject
to the warning – there may be other non-compliances noted in the
warning that are not flagged on the database.
 3. Verbal warnings issued by Animal Management Officers are not captured
in the database and therefore not included in the table provided.

 

For these reasons we are not able to interrogate the database to
particularise the enforcement responses for non-compliances in cemeteries
specifically. We can conduct a search of enforcement responses relevant to
a particular street address. Therefore if you have an address for a
particular cemetery that you would like data for then we can search our
records on the basis of that address.

 

Please also note that Animal Management Officers can issue verbal warnings
and compliance advice to dog owners where it is a first time offence or an
isolated issue. As noted above, verbal warnings are not captured in the
database; and only the primary non-compliance subject to the warning is
recorded. This means that there may have been additional enforcement
responses issued for wandering dogs that are not captured in the table.

 

Further detailed information in relation to verbal warnings and location
data (such as cemeteries) could only be provided via a manual review of
thousands of individual complaints records. Therefore we have decided to
refuse this part of your request under the following section of the
LGOIMA:

 

·         17(f) – the information requested cannot be made available
without substantial collation or research
