Good morning again Erin
Further to the below, we now have all the information to be able to answer Mr Luke’s questions. Our responses are in red below, and attached:
Toi Ohomai has only made one advanced academic appointment, an Honorary Professor appointment, bestowed on Mr Chuan Qin
Mr Chuan Qin’s cv is attached.
This appointment was for two years from June 2018.
We attach our draft Advanced Academic Position policy and draft Advanced Academic Appointment procedure. These documents were drafted back in 2018 but still have the draft watermark as they have not completed Toi Ohomai’s formal policy process as yet.

Subject: FW: Preliminary inquiry - OIA delay - our ref: 527455 - John Luke
Good morning Erin
This is the first time our organisation has seen this OIA request. I will action and respond to Mr Luke directly. Please let us have Mr Luke’s email address.
Please also advise Mr Luke that on 1 May 2016 Bay of Plenty Polytechnic and Waiariki Institute of Technology merged and we are now known as Toi Ohomai Institute of Technology Limited. It is possible that the email address Mr Luke used to make his request, is no longer monitored.

Subject: Preliminary inquiry - OIA delay - our ref: 527455 - John Luke
Good morning
A complaint has been received from Mr John Luke about a delay in responding to his Official Information Act 1982 (OIA).
The background to the matter is on 11 April 2020, Mr Luke made the following request via FYI:
I would like to know the name of current Honorary and Adjunct Appointments and separate by their title, (E.g. honorary lecturer, senior lecturer, associate professor, professor). Also their bio as well.
Further I understand, Honorary and adjunct appointments are usually for a period of up to three years and appointees may be reappointed as appropriate. May I have their term of appointment.
Also, your process and procedure of appoint people for this kind of role and do you formal appointment for guest lecture or industry expert like the other NZ Uni does?
In accordance with the current approach of the Chief Ombudsman to delay issues, there are a number of questions that we will need a response to:
1. When was the request from Mr Luke received by Toi Ohomai Institute of Technology?
2. Was the timeframe for making a decision and communicating it to the requester ever extended? If so, please provide copies of any letters or emails sent to Mr Luke?
3. Was the timeframe for making a decision and communicating it to the requester ever amended or clarified? If so, please provide copies of any letters or emails sent to Mr Luke.
4. Does Toi Ohomai Institute of Technology accept that there has been a delay in making and communicating a decision in this case?
5. Has Toi Ohomai Institute of Tecnology now made and communicated a decision on the request? If so, please provide a copy of the decision to the Chief Ombudsman. If not, please advise when Toi Ohomai Institute of Technology expects to be able to make and communicate a decision.
I would be grateful if you could please respond to these questions by 22 June 2020.
Please note: if you accept that there was a delay (ie, a failure to meet the timeliness requirements imposed by the OIA / LGOIMA) and confirm that a decision on the request has been made and communicated to the requester (and provide a copy) by 22 June 2020, the Chief Ombudsman will likely decline to investigate the complaint on the basis that an investigation is ‘unnecessary’. However, if we do not receive a response from you by the above date, or if a decision is not made on the request and communicated to the requester by that date, it is likely that a formal investigation will be commenced.
