Club Merger – Avondale RSA Inc and New Zealand ‘All Golds’ Cosmopolitan Club Inc

Thank you for your letter of 10 July 2017.
You have asked us to consider an application for territorial authority consent for an increase in
gaming machines at the Avondale RSA Inc venue at 3 – 7 Layard Street Avondale. The increase will
arise from a proposed merger of the Avondale RSA Inc and the New Zealand ‘All Golds’
Cosmopolitan Club Inc.
The consent of the Auckland Council to such an increase is required by sections 95(1)(f) and 98(a) of
the Gambling Act 2003.
Considerations
The Avondale RSA is currently licensed to operate up to 18 gaming machines at its site while the New
Zealand ‘All Golds’ Cosmopolitan Club
is currently licensed to operate up to 9 gaming machines at its
site at 2 – 48 Ash Street Avondale.
The Council’s
Class 4 Gambling (Pokies) Venue Policy states that the Council will grant consent to an
increase in gaming machines where:
•
It is satisfied that the merging venues are both Club venues, and
•
The place where the two venues are being merged to holds a current Class 4 Gambling
venue licence, and
•
The number of machines in the merged club venue will be no more than 5/6ths of the sum of
the number permitted in the two clubs Class 4 Gambling venue licences.

In this instance:
•
Both merging clubs have Club venues;
•
The merged clubs will operate from 3 – 7 Layard Street Avondale, which has a current Class
4 Gambling venue licence;
•
The maximum number of machines to be operated from 3 – 7 Layard Street Avondale will be
22 which is 5/6ths of the number permitted in the two clubs’ Class 4 Gambling venue licences
(27 machines) rounded down.
Decision
Accordingly, consent is granted for the purposes of section 95(1)(f) of the Gambling Act 2003, for the
maximum number of gaming machines at 3 – 7 Layard Street to increase to 22 on the merger of the
two clubs.
We note that this consent is limited to the council’s jurisdiction under the Gambling Act 2003. It does
not extend to any permits, consents, certificates, licenses or similar that may be required under any
other legislation.
